EE pre-contract information issue

Hi,

I have just found out about this and would like some advice -https://www.moneysavingexpert.com/news/2024/05/ee-plusnet-bt-refund-exit-fee-ofcom/

I took my contract out in March 2024 with EE through a 3rd party provider and never received any pre-contract information before I signed up. I have asked the company for this information from the time I signed up and they cannot provide me with any evidence that anything was ever sent to me.

Should I be allowed to leave penalty free if I never got this information the first time round?

    This is very much the first thing to think about.

    It's all well and good leaving a supplier but you haven't saved anything if you then sign up elsewhere on less favourable terms (remember Martin's advice that moneysaving doesn't equal cheaper - you have to factor in what's called the total cost of ownership). 

    So work out where you'd go and what it would actually cost you.

    I was going to go to ID mobile, rest of the family are on it and coverage is good and cheaper than the current EE contract. If they can not provide evidence that the pre contract information was sent at the time, I am allowed to leave penalty free and how should I go about this?

    The MSE article you've quoted is rather light on the detail.

    Are you on a SIM-only or phone'n'SIM deal? If the latter, does the 'no early termination fees' apply to just the airtime or to the phone deal too?

    You got your deal through a third party, what do their Terms say about ending your contract early?

    I have switched mobile networks a few times and never been sent anything "up front". You should have read the T&Cs on their web pages before agreeing to anything. Have you checked the EE pages?
