The deeds aren't going to really help the nephew + gf as they end with a conveyance from his seller to him presumably. The deeds aren't going to help them unless he then transfers the legal ownership to them or he dies and his executor then transfers the property to them.adeo said:

You need to double check on the registration question. If the property is not registered, and what has gone astray is the documentation that would prove the ownership, you may have quite a tangle to sort out as and when registration is needed.adeo said:

If he is leaving his house to you in his will - then the land registry would not have any record of this. The deeds would only be changed after he dies. This is something the executor of the will would be able to do having obtained probate - but the original will would be needed for this.adeo said:My dad put me in his will naming me as to taking ownership of his fully paid mortgage home several years ago. Be careful to avoid unofficial sites which charge more to access the same information.
(I see from previous threads you seem to be under the impression that being the executor of a will gives you responsibilities and rights to act on financial matters while someone is still alive - this is a misunderstanding).Edit to addBack in 2023 you said that your Dad had given the deeds to you - is there a chance that you still had them, but had forgotten about it?
Clearly not having the original deeds, which are his proof of ownership, is an issue and very much a case of seeking legal advice to understand what the legal position is both now and in the future re what might happen next re health, care, death, will etc - ensuring you are all on the same page and explaining that getting the property registered now, with the original deeds, is the best way forward to avoid any issues later when he or his executor need to deal with the property
There's no real clear gain for nephew + gf to take and keep the deeds unless they are then able to make everything else work for them such as the will and probate as well. Seems unlikely but that's very much where your legal advice needs to come in“Official Company Representative

Hello.Sorry for taking so long to respond but I've been having health concerns since last November! I appreciate your information, so thank you.BTW I'm the trustee and executor named on my dad's will. So from what you have said I have nothing to worry about regarding the fact that I will be taking over ownership of my dad's house upon his death as my dad instructed, even though my nephew and his GF have been living at my dad's house for over ten years+ . But I would like to get the deeds/land registration sorted out before my dad's death. Would we have to sort this out via my dad's existing solicitor who my dad's will was originally written with. Or can I do this online with land registry?0 -
I'd agree that the 'worry' may not be as great as before you posted but still very much something to seek wider/legal advice on as posted. Owning, living in and taking over are all very different considerations and it seems to me at least that you need to confirm and understand what legal rights your nephew + GF have and/or what they think they have in your scenario both now and in the future.adeo said:@Land_Registry

Solicitors are invariably employed for specific needs. There's no obligation to use the same solicitor to do the will and then later register the property.
