Group Nexus overstayed parking charge due to preorder queue.

  • Hey folks, I've got a called from the store manager and he said that they rejected the appeal.
    BritishLand forwarded my email on Monday 17th to the relevant department and I have not heard of anything since then. GroupNexus has sent me another letter just to say that you've lost the chance to pay at the reduced price. 

    This upcoming week will be the 4th week and I think the next best course of action would be to use Plan B and send in an appeal directly to GroupNexus and not miss the appeal window right?

    Doesn't matter too much if you appeal it not but yes, if you want to futilely go through the motions, do.

    Your options in a BPA AOS member case like this one are


    Plan A,  A strong complaint to the company who hired the private parking company 

    Plan B , Bung in an appeal to the private parking company who issued the pcn, which may be futile 

    Plan C,  Construct a suitable POPLA appeal and upload it to POPLA, once you receive a POPLA code

    Plan D, Defend yourself in court within a Money Claim issued by lawyers acting for the claimant parking company 


    Ignore any powerless debt collectors letters

    Wait for a Letter of Claim and the inevitable DCB Legal sourced bulk claim.
    Defend this and see them discontinue.

    Yes, appeal is futile but nobody has to pay. Defending a claim form is ten times easier than any appeal! No risk, no CCJ, they discontinue, scam over.

    Are you still of the mindset that this parking company has some sort of authority? They are just a two bit scammer that has joined the bandwagon of creaming free money from motorists for doing very little other than sending out carefully worded letters.
    The appeals process should look at each appeal on merit against the details and where there are good grounds like yours cancel.
    But there is no incentive to cancel, there are no checks by anyone against fairness, it's all controlled by the greed of the parking company bosses there is no comeback.
    POPLA only look at the process, contracts signage etc., and you have to lead them by the hand with that they do nothing at all to assist you, most people wrongly think they are independent and wrongly think that if they repeat the incident details POPLA adjudicate the decision made they don't. 
    POPLA are paid by the parking operators so just imagine who they try to favour, even when they admit their slightly dim staff make a big mistake they state it's a one stage appeal the person has been retrained, but hard luck you. But yet we have seen mistakes made against the parking company reversed go figure how their one stage appeal fits that scenario.
    The only truly independent "appeal" is through the courts, the parking companies know this and will take a good defended case to the eleventh hour as a frightener then withdraw at the last moment.
    Undefended cases they love because it's an excuse to get a default judgement with all the added cost included and little effort but some templated documentation submissions.
    Don't let these scammers grind you down, and don't let the sham appeal system fool you.

    GroupNexus invoices eventually go to DCB Legal, who will make a bulk court claim, which you defend online and then they discontinue a few months later.

    So just ignore until you receive a county court claim through the door.

    Worth going through the motions because then you're prepared for next time.

    These are like Covid cases. Remember when they said everybody would catch it eventually? It's the same with private parking tickets.

    You'll be getting more of these in your driving lifetime.
