Knocking on his door several times a day and night with requests for him to clean up would probably be annoying for him; as annoying as having a tip in the front garden is for others.

BIB - I doubt that very much. I think he'd love it, based on his maverick attitude.
In any case, it would likely be harassment.

Judging by the article, once there was a sculpture of a mammoth in that place (by the same "artist") but it fell into disrepair and so they piled shopping trollies etc. on
And the mammoth was really impressive

    "We can't sell house becuase..."

I am a bit confused, you live in the south west of the country your quoting a Manchester newspapers clickbait article about a property north of the Forth, how is that affecting you selling house.

For what its worth properties in the surrounding area do seem to sell quite well as it is a nice area with good schools and recreation available along with good transport links, especially to the Capital and all the job opportunities there. There may be a problem at the street level but as always a property is only worth what someone is willing to pay for it.

If I was his neighbour I would be looking at someway to monetise the issue, set up a webpage along the lines of  "What's He up to now" and see if that could generate some income.

I was of the opinion the initial installation's added a bit of interest, the Galleon in the tree especially in the winter when the leaves are off the trees.

Play with the expectation of winning not the fear of failure.    S.Clarke

I understand it is possible to sue a neighbour for devaluating your property by their deliberate and unreasonable behaviour

From where did you gain that understanding?
You, say, demonstrate that there's a 'nuisance' being caused by the rubbish, or by the neighbour's recalcitrance, which shouldn't be hard to do; the long-term involvement by the council (they don't try and act for no reason), visitor's attitude to your home, what other neighbours also feel about it, and how it 'spoils your rightful enjoyment', etc. And then you demonstrate the 'loss', which should be even easier, such as an EA's valuation, or even an attempt at sale, with viewer's feedback citing the mess.
A litigator worth their salt should surely?

So what law are you relying on?

You can get a court to order them to stop causing the nuisance, I've never heard of anyone making a claim for the £xK their nuisance has allegedly caused (and obviously if the nuisance ceases then the property value bounces back up anyway?).

I'm not citing a law. I recall an article about a similar situation, that's all. This is a conversation - jeeezzzuzzz
Hang on - you don't construct massif mammoths in your gard... Nah

Please don't be confused. It's funny, and interesting. It seems to be real. That's all.
I like your idea - almost anything is exploitable these days.

I better not bring up the situation at Sandbanks... One of the 'posh' residents erected a large timber fence going down to the sea to try and block off rightful access to pedestrians along the beach - at med-to-high tides, the end of the fence is in the water.
Locals are miffed, and one was greeted by the owner coming out with a megaphone to shout about getting off their garden.
Well... I'd get a bigger megaphone to reply with. Oh, and get caught on their side of the fence when the tide comes in, so have to settle down for a picnic while it turns.
    I wouldn't really - but I'd love to.

  • I wouldn't greatly mind the mammoth itself (its just the junk piled on it that makes it look bad), the pirate ship (real impressive actually) or even the gateway. Bit of whimsy never hurts and as long as theirs not pest problems I don't care.

What stands out to me is the fire hazard aspect, certainly of the rear garden which appears to be some kind of long (full garden length) makeshift wooden building (obviously not within permitted regulations). Surely they can have that part removed just for that alone.

I can't believe Nov 5th passed without incident...

  • You can contact the council.  If the rubbish is causing a health hazard they can force the owners to remove it.  If it’s just untidy then the council can’t do anything about it.

The plastic police are giving out lots of fines recently where I live, the police 'community wardens' division also publicly 'name and shame' fined houses on the police page and local facebook page.

Some houses hit honestly dont even look that bad, some are just a few old past their best outdoor kids toys etc...

Our old house got hit with a pre-fine warning from them for having Ivy up the front which they claimed 'makes the area look untidy'. We didn't plant the Ivy its always been there (a mild nuisance to us as it kept trying to come in windows/doors or stick the door shut) but 'looks' wise I think it was quite nice and English country cottage like growing up the old sandstone.

So, is this actually your house, or just a click-bait discussion thread that would be better placed in the Discussion Time area of the forum?
