Appealing APCOA without expired code
Comments
-
As a general rule*, for Airport land, the advice isn't to appeal on the basis that you do not need to identify the driver; it is to appeal on the basis that the keeper cannot be held liable*.
*This is assuming that the land is land on which parking is subject to statutory control, but whether that is the case depends on which Airport, what the byelaws say, and where the byelaws apply.
As Chirpy says, come back here if you get a court claim. In the meantime, ignore them, unless it's to tell them you've moved house.

Its not a defence, its a statement , no keeper liability ( but there could be driver liability. )
If they were to issue a court claim against you, your statement may back up your case, IF YOU WERE NOT THE DRIVER
So the merits of the case will be discussed if a court claim against you from the CNBC in Northampton were to arrive in the post
Stop overthinking this stage, its all irrelevant unless you receive an LBC or a Money Claim

So is it a good idea to block texts or not?
0 -
That is your choice to make, but they can easily use a different number, so blocking one number doesn't have much effect, unless they only ever use the one number

yes they serve no purpose

Of course. You don't want texts from this lot.
Please show me the full communication from Empira, a screenshot proving it came from them and what they said, so I can use it as evidence for the MHCLG (Google them)!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Just for my peace of my mind, can I confirm that this "notice of intent" is no more than bluff at this point and I can continue to ignore?

I would not assume that its bluff, but its still a debt collector letter

I mean because apparently apcoa never actually take anyone to litigation so I was wondering if this indicates an exception or is it just typical of what they would write to make you think they are going to go to court?
