Car finance and agreement refunds

    No as it was his finance, he may be entitled to a compensation if there was some form of miss-selling involved and it would be between the two of you if he passes it over or not. 

    PPI is irrelevant, the boat to claim that sailed a long time ago.

    Still confused, unless there has been some payment of compensation which you are now trying to get your hands on, as the loan was in 2006 there is no bandwagon to hitch a ride on.
  • Why are you overcomplicating the situation?  If your ex-partner is happy to confirm that any payments should go to you in the event of compensation being awarded, then presumably you're on reasonable terms, in which case, why not get him to claim and if successful, he simply hands the money to you?

    What's all the stuff about rescinding payments about?

    There are no consumer rights & given a 3rd party took out the finance for you, there is a possibility that it was against the terms of the finance. Why not take it out yourself?
    So maybe a boat not worth rocking.

    Seeing as the finance was in 2006 I'm pretty certain that boat isn't even in the regatta.

    You can waive your right to compensation if you dont want it, ie rescind it, but dont think you mean rescind but instead reassign.

    A finance company is unlikely to be willing to allow it to be reassigned, it opens a load of questions which they simply won't be willing to pay for legal advice to be able to get comfortable with the suggestion -v- just paying their former customer and allowing them to then transfer the money to anyone else they want to as a gift. Compensation includes interest which must be reported to HMRC, they will be concerned that this is a potential tax evasion attempt that you want the interest to be paid to a lower rate tax payer than who its genuinely due to etc.

Still, it might be best to contact the lender or PPI claims department directly and explain the situation so they can confirm how they’ll handle it. They’ll usually ask for proof of payment and identity before releasing anything.

    Hi, thank you for your non-speculative and constructive reply. I do still have all the paperwork, documents and proof of payments, in fact I still have the car! I'll take some further advice, just not on this forum. Thanks again, Claire 
  • Just to clarify, I'm not 'trying to get my hands' on anything, there is no 'potential tax evasion' and I don't need to explain my personal circumstances at the time. 'Possibly' and 'maybe' isn't constructive and having successfully claimed ALL of my PPI back independently, I don't need a boat or a bandwagon. It's a shame there isn't a thumbs down for unhelpful comments.
