Despite failing miserably on PoFA timeline requirements, they still issue a PoFA warning paragraph. A complaint to the DVLA that this outfit has issued a wholly misleading NtK should be made.

Has your father received a rejection to his appeal with a POPLA code?

Yes, he received a rejection letter with a POPLA code.

Reason given for rejecting appeal was
"It is the driver’s responsibility to always ensure they are fully aware of and adhere to the Terms and Conditions when parking on private land. "

Is there an example somewhere of what to say in complaint to DVLA? 

1. What is the date on the rejection letter?

2. No template. Just complain that the PPC is threatening keeper liability under the Protection of Freedoms Act 2012 (the law) in their NtK, when they have no justification in doing so as their NtK hopelessly fails to comply with PoFA (explain dates between the parking event and the issue of NtK). Tell them that this is misleading and unlawfully threatening. 

Ask them to investigate and report back to you, with details of what sanctions will apply. State that you are aware that in the past, similarly offending PPCs have received temporary bans from accessing DVLA data.

1. 23rd October, giving 14 days (until 6th November) to pay the reduced £60 rate. Appeal was made on 19th September.

Does the rejection letter confirm your POPLA deadline date?

Start building your POPLA appeal using the near-template appeal points from the NEWBIES FAQ Announcement, third post.  Make sure your very first appeal point will be 'No Keeper Liability' where you will highlight exactly why that is. Some POPLA Assessors are not the sharpest knives in the drawer, so you will need to spell it out very simply for them. 

Let's see your draft before submitting. Don't miss your POPLA deadline. This should be very easy to get POPLA to uphold your appeal. 

The rejection letter said POPLA deadline is 28 days from date of the letter, which would be 20th November.

Will that even work saying no keeper liability in the POPLA appeal? can't be sure exactly what he said as he didn't keep a copy, but think my dad has already stated or strongly implied he was the driver in his initial appeal, and/or ticked 'I was the driver' when filing the appeal.

Not if he's admitted to being the driver.  Sorry. Load the appealed with all the other points from the NEWBIES FAQ Announcement, third post, then see how the PPC responds to those. Even if the POPLA appeal is lost, no need to pay. Only a Judge can tell you to do so. 

I keep referring to 'you' in my replies, but if the charge is in your father's name, it's his to deal with. You can do the work, but everything in his name only!
