So a little update… I’ve had DCB ring me 3 times for a ‘without prejudice’ chat and offer to settle out of court for £280 which I declined.

I also had mediation yesterday, which I offered the £2.50 which was the difference between what I paid and the van minimum charge which was buried in the small print, they offered to settle for £180 (which is £100 less than the without prejudice calls) I declined and said I’m willing to pay the damages suffered, due to their insufficient and misleading signage.

They replied with it’s the drivers responsibly to read the signs including the small print and pay the correct fee… so I guess I now wait until I hear off the court with a hearing date.

Correct, wait for your court order from your local civil court that you nominated in your N180 DQ document

does this mean the court fee is paid and it will likely be going ahead or is there still chance they will pull the plug?

No, you aren't yet at hearing stage.

That just means a judge will issue Directions to both parties, likely in May or June. And yes DCB Legal (almost always) discontinue before their deadline to pay the hearing fee.

Just checking back in regarding this case, I have received directions and a hearing date from the judge. DCB have been quite persistent via phone and email saying the client is willing to settle out of court most recent was £200.

Hearing date is set for the 7th of August at Newport (South Wales) county court. Does anybody have any experience here?

Court fee must be paid by the claimant no later than the 10th July.

Witness statement by 25th June. I need to search the forum to prepare my statement, is there any useful tips based on my scenario and claim form I should be looking at specifically?

I stuck by my initial mediation offer of £3 settlement ‘without prejudice’ which was the cost of damages suffered initially, which they turn their nose up at. I kind of like lowballing them, but requested they take my number off their system and stop calling me. So they started emailing me instead…

Thanks for this, I’ll check it and put something together and share here for opinions before sending to the court.

It’s a shame the court fee isn’t due before me having to submit my WS.
