But what you have shown us isn't the Template Defence.Sparky1056 said:I have submitted the AoS today 28/10.Is there any benefit in longing out the defence, or can I submit and get the ball rolling to come to a quicker conclusion?
I will re edit this and use the template from the pinned thread, with the following only for paragraph 3 (have tweaked it slightly) does
it look ok? Sorry this is my first time and all new to me!
3. The defendant parked their van in the car park. There were frequent signs stating "£2.50 all day parking", including at all entrances and a large highly displayed billboard, and so this the amount the defendant paid. Only on later inspection did it turn out a higher price of £5.50 for vans was applicable, as this was buried in the small print. Therefore it is submitted that the claimant's alleged contract was insufficiently communicated and misleading to have been valid and in breach of the CRA 2015, which states:Requirement for transparency
(1)A trader must ensure that a written term of a consumer contract, or a consumer notice in writing, is transparent.
(2)A consumer notice is transparent for the purposes of subsection (1) if it is expressed in plain and intelligible language and it is legible."

I received the directions questionnaire a week ago and today received a call from DCB legal, for a chat ‘without prejudice’ they said their client is willing to settle out of court today for £280. I declined and said I am happy to proceed with mediation and court based on my defence. Is this normal tactics or could it be a sign they know they will pull the plug before court and hoping to get at least some money from me?0

Standard stuff, follow the 8 steps in the defence template thread in announcements
They already knew that they would pull the plug before the hearing fee is due when they sent the LoC and then the Money Claim. That is how it works, their M.O, , to badger people into paying, or to obtain default CCJs against those victims that dont deal with it, including those who never received paperwork3 -

Is there a current email address to CC in DCB legal Ltd on the N180? I don’t seem to have any email addresses for them on any of the paperwork only phone numbers.0 -
Use the info@ email address for DCB Legal, same as everyone else
Download the N180 DQ document from the government website and fill it in, save, attach to an email and send to both. ( or fill it in online, save, download etc. ). No paperwork, no scans or pictures, no posting it. )3 -
When is the hearing fee due? Is there anyway I can find out if this has been paid? If payment isn’t made by the due date does that mean the hearing won’t go ahead?0

Obviously you'll need to ring the local court to ask that question (but you should know when it was or is due because it is stated in the hearing order).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
