Bespoke but not to me

Hi there, apologies my first post on here is asking for help but I am at a bit of a loss

I ordered bespoke blackout blinds and curtains via a local tradesperson.  We asked for them to be fitted outside the window recess to the blind maker and the designer, who commissioned her.

Unfortunately when she delivered the blinds they were made to fit inside the window recess.

We obviously complained and refused to pay anything above the 50% deposit we had paid. We tried to return the blinds and she sent them back.

I know laws are different for bespoke.  But she said because a quote was sent and we paid a deposit thats us saying the measurements are right.  Where do we stand in law as my view was we tried to contact her about the quote and she wouldn't respond so we couldn't question the dimensions anyway but also, I wouldn't know what the measurements would be as i'm not a professional blind fitter, hence why we commissioned somebody else.

Anybody have any ideas?

    The law on return of bespoke is in relation to change of mind, they still have to be fit for purpose etc. 

    You talk about a trades person, a blind maker and a designer, it's not clear if these are three different people or one and the same person. If they are more than one person would need to understand the relationship between them all. 

    The person who you instructed and told you wanted them to be outside the window recess, what have they said about them being too small and designed to go into the recess? 

    Are these proper blackout blinds or just very opaque blinds? I thought proper blackout blinds have to go into the recess and there is a track for the edge of the blind to go in so no light can get round the edges. Can't see how you could avoid any light escaping if they are outside of the recess.

    If you are saying the blinds fit in the recess then somebody must have measured to fit exactly in that space.

    Are the wrong blinds for each individual sealed unit for a window?

    A photo of your window may help or a copy of the order with details redacted could shed some light on the matter.

    Do you have anything in writing stating that the blinds are to be fitted outside the recess? 

    If you don’t, that could be a big problem. As you will have received exactly what was written down.

    Did you not see where the person was measuring?

    If they were measuring inside the recess that should have alerted you. 

    I am sure you know the difference between measuring inside and outside  a recess.

    Sorry but this is terribly confusing.

    So there are three people?  The designer, the manufacturer and the blind fitter?

    The designer commissioned the blind fitter, and the blind fitter visited you and measured up?

    Who did you tell that the blinds needed to be outside the recess?  The designer or the blind fitter or both?

    Which of the three parties actually sold you the blinds?  (ie who did you pay?)

    [Edit:  it's not clear to me why you would be pursuing the blind fitter if you didn't buy the blinds from them]

    Has she (whoever "she" is) acknowledged that the blinds should have fitted outside the recess?

    Why did you try to contact her about the quote?
