Victim of Park direct UK Ltd - Uxbridge

Evening all, 

This is my first thread in this forum and also my first ever POPLA appeal. I received a PCN in Uxbridge for stopping to pick up my wife, in this time my lights were still on and I didn’t leave the vehicle. I stopped for less than 4 minutes in total. 

After submitting my appeal and it getting denied, have I come across this wonderful forum. Unfortunately I did appeal and put myself down as the driver of the vehicle for my wife’s car. 

Really sorry if I should have posted this elsewhere or not at all (it’s my first time). But was wondering if I can get some help regarding, how to tackle this company and hopefully win through POPLA. I’ve attached the response I received to this. Thank you all in advance.

    See the newbies sticky thread in announcements near the top of the forum by coupon mad 

    Ignore them for now 

    Come back to this thread if or when you receive a Letter of Claim giving you 30 days notice,  or a Money Claim

    You were stopped, loading, not "parked" , no parking occurred

    If the signs say, no parking, then there is no offer,  no consideration,  no contract 

    You may have been trespassing,  but that aspect is betwee you and the landowner 

    Lastly,  they are not forced to do anything,  they voluntarily chose to uphold the pcn

    POPLA is not available for this company as they are IPC members and only offer access to the IAS which is a complete waste of time.  The IAS no longer publishes their statistics but when they did, it was 95% in favour of the companies.  Do not bother.

    It is interesting that they have admitted there is a consideration period but have conveniently omitted what that period actually is.  The Single Code of Practice says that it's 5 minutes where parking is normally allowed.

    Regardless, you were not parked. Loading/unloading of passengers or goods is not parking.
    Always remember to abide by Space Corps Directive 39436175880932/B:
    'All nations attending the conference are only allocated one parking space.'

    Why did you drive off street onto a shop forecourt or layby or whatever? You'd obviously get cameras on your car in such a place. These are typical scam sites and this one is well known.

    Even if you didn't know, this is what you should do differently, next time:

    When picking up a passenger you should ALWAYS stay on street. You can stop at any kerb. Especially at night when any on-street restrictions are over, you can pull over literally anywhere (except a red route or bus stop) and to pick up or set down a passenger you can always use a single or double yellow line.

    That's what double yellow lines are provided for: 'exempt activity' like loading and picking up or setting down passengers. I'm constantly amazed that so many drivers think double yellows mean no stopping ... but I realise this place is a complete trap.

    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Thank you everyone for your replies, I’ve put some pictures to show that they were taken by someone in a car behind me. The area is not well lit and regards to not parking on a yellow line, the main road was full with parked cars leading to a no entry road for buses. 

    If this company is IPC does that mean I shouldn’t even entertain appealing or even paying for this charge?

    I’ll take a drive to the area over the weekend to capture footage of the area and the sign.

    Park Direct UK used to use Gladstones back in the day, but don't appear to have made any court claims for years. With the exception of a £3000k case they took a punt on themselves in-house.

    Their "successful court claims" page on their website is amusingly blank.

    Just ignore them.

    This site is a honeytrap for them it, crops up on here time and time again, they must make a fortune that's why they have a muppet there permanently catching people.
    The signage is deficient and has been for years, and as @Gr1pr states you were in an alleged no parking at any time area, so effectively trespassing not parking.
    So there can be no offer of a contract, they cannot charge you a fee for trespass, if they don't want you in there they should install a barrier, cones or retractable bollards, or at the very least put up clear signage at the entrance. But none of this would make money, and I bet the landowner gets a cut from every successful PCN issued.
