Hello,
Please help me with this ticket I got.
The story goes, I paid to park on a Sunday, the feeling is 60p for the whole day, I only stayed around 1hr30mins, when I paid I did so with cash at the machine.
It didn't print any tickets which I thought was strange but then seen a sign for "Pay and Stay" which I thought ok it's not "Pay and Display" so must work on the reg I put in, which I now know looking back this was a mistake.
I then got this PCN through the post, I don't have any proof of payment, but even if I did get a ticket it would have been binned by now anyway.
I've read about Minster Baywatch and Barnaby Wilson as most signs here have the latter name but also read a forum member here who went to court with that argument and lost. I have appealed through them which I know they won't uphold so no doubt I will end up in court with them if it makes it that far.
What can I do now, what angle of defence should I be going in with? I will find it hard to prove my innocence but also they will find it hard to prove my guilt? They have a picture of me entering and exiting the carpark but that's it.

Did you out the driver in your appeal?

You have to read and accept the contract offered by Minster.
If tariffboards and signs from by a separate company dominate, it become a "Where's Wally?" situation. You can't enter into a contract with Minster if the contract is obscured.3 -
Hello, would you reccomend I wait until they take me court and fight it on this angle? I did read another post on here and they lost using the Bransby Wilson argument. You're not limited to one defence point though.3

Why are you talking about court at this stage?. They should formally reject your appeal and offer POPLA. As CM said, you should win on the Bransby bit. There's one POPLA appeal you can use as a template, search Blossom Street or Bransby Wilson on this forum.
It is my understanding that MBs NtKs are PoFA compliant from a previous post with a letter the same as yours.
This is a devious company. I'm currently having a right battle with them for my daughter. No rejection letter following appeal, no offer of POPLA, straight to debt collection, no DVLA response on when they obtained driver details (after 3 requests), no response from my MP, no response to formal complaint to MB. Now awaiting response from BPA.
Keep this board in the loop..

I will of course appeal and go through POPLA but just preparing for the worst, rather than getting to that stage and not having any idea what to do.2 -

You will EASILY win this at POPLA, like I said.
