    But it doesn't matter. Nobody cares about kangaroo court IAS decisions but it is worth a try as 20% of PPCs drop out. If not, ignore it.

    Don’t use the words “mitigating circumstances”, quote the Single Code of Practice at them. 

    A medical emergency is an exemption according to their own code. Stating this might make them withdraw. If they don’t then that’s all good evidence for any later court claim.

    Potentially fraudulent if they falsely claim mitigating circumstances are never a lawful reason for the charge not be owed under contract law.

    You are not appealing about mitigating circumstances, you are appealing about the operator not complying with their ATAs COP that they have signed up to and MUST adhere or risk sanctions!
