Good afternoon
Parking ticket issued in BP petrol station East Midlands Airport for less than 5 Minutes parking on Parking bay at 4 a.m.
I was the driver and I suffer from Multiple Sclerosis, relapsing and remitting. I had my parking booked at airport parking but when I approached the roundabout I had a relapsing attack for which I had to pull over some where safe..
I appealed the £60 based on medical emergency but it was declined.
My optiion is to appeal further to BPA.
My question is is it worth apealing?
Any advice much appreciated.

Ourmain reason(s) for this decision are as follows:The signs at the Customer Bays make it clear that the land is private property and that a Charge of £100 will be leviedif vehicles stop/park contrary to the Terms and Conditions displayed. The signs in proximity to where the abovedetailed vehicle parked clearly indicate that these bays are for customers of the Fuel Station only specifically stating"Strictly Customer Parking Only Whilst on the Premises". The above detailed vehicle parked in the customer baysand as the driver was not a customer of the Fuel Station, the driver became liable for the Charge advertised.In your appeal you have confirmed to us that on the date in question, you were the driver of the above vehicle.A review of our CCTV evidence has confirmed that on the date in question, your vehicle stopped for an unreasonableamount of time in the Fuel Station where restrictions apply.We maintain that the signs on this site meet the requirements set by the International Parking Community (IPC) Codeof Practice. The signs are large, prominent and legible ,so that any reasonable motorist would be aware of theirexistence and nature, and would have a fair opportunity to read them if he or she wished to do so. It can never be adefence to a claim in contract law to say, "I did not read the terms", so long as the existence of those terms is reasonably advertised.
Signs on site clearly display a Helpline telephone number which is available for use by motorists who have anyproblems or queries in respect of their use of the site. In this case the driver should have called that Helpline so thatarrangements could be made or advice given in respect of any problem they had.We have fully reviewed this case and we are satisfied that the Charge Notice was correctly issued. We are unable toaccept the mitigating circumstances raised in your representations, your appeal is therefore rejected and the Chargewill stand; photographic evidence which supports this can be viewed at www.myparkingcharge.co.uk.What you should do next - Either:1. Pay the Charge Notice (CN): In order to settle the Charge, the payment of £60 to reach us by 14/10/2025 or £100to reach us by 28/10/2025 must be made. Contact the EMA Airport owners AND the BP Garage owner (MFG?) with evidence of your MS, the Airport Parking booking and the rejection letter and ask if they are content that their agents are breaching both the Airport Byelaws (there is an exemption for emergency stops) and breaching their statutory duty under the Equality Act 2010, by refusing to make a 'reasonable adjustment' for a disabled service user.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

This is also a breach of the Single Code of Practice Annex F:"Parking charges must not be pursued in relation to vehicles where evidence is provided that they are identified as:
e) a vehicle that has been driven onto controlled land due to an emergency which could not be avoided due to the exceptional nature of an incident outside of the control of the driver, e.g. serious illness;
NOTE: An emergency is a serious, unexpected, and dangerous situation requiring immediate action."
If the driver is too unwell to drive that would be a dangerous situation requiring immediate action.Always remember to abide by Space Corps Directive 39436175880932/B:
