So I had the mediation phonecall on this where they offered to end it all if I paid £190, which I didn't take them up on. During the mediation back and forth they claimed they DID reply to my original appeal by email, which I defintely didn't receive. I said to the medaition lady that if they can produce the email logs proving this I will happily pay the £190, but they didn't, and the mediation session was then closed as unresolved. I have now received a letter from HM Courts notifying me that 'the Court file has been referred to a Disrtrict Judge for directions'. Are they now taking this the full distance as they think they can win and things like them not willing to supply proof of them sending me an email are just irrelevant?

Ouch! Never say that in your WS. That was a huge amount to offer.

I think this was a risky thing to say because they can attach an email to their exhibits now. Not that they can refer to Mediation conversations in a WS (but they can when it comes to costs at the hearing).

Anyway WS and evidence exchange next. This isn't a DCB Legal led claim is it? Just CEL in-house?

  • But what email? I'm very tech savvy and they 100% will not be able to produce anything other than forged email logs. I didn't say this in my WS, it was just something they came back with via the mediator, and I was probablty being a bit flipant when I said that if they can produce any evidence I'd be happy to accept my mistake and pretty sure I didn't give an actual figure. Prior to that I offered £1, which was the original cost of the parking I wasn't able to pay for. Not sure who DCB Legal are - every bit of corresponence only mentions CEL. Do they usually take it this far as this must be costing them more surely?

Yes CEL usually go to hearings (not always).

But you haven't done your WS yet.

All stages are shown under the red heading 'IMPORTANT: KNOW WHAT HAPPENS WHEN' in post 2 of the NEWBIES thread.
