On what grounds has the claim been repudiated?4PostLift said:looking for info regarding insurance refusing to pay out on my sons stolen vehicle, vehicle stolen from secure parking area in Manchester while he was working abroad, case was sent by Insurance Company to Loss Adjuster who refuse to reply to lawyers letters therefore we cant go to Ombudsman, how can we take this further
Why are you paying for lawyers rather than just complaining yourself?
You can go to the ombudsman after 8 weeks if you still dont have a Final Response to your complaint by then.1 -
Your son's contract is with the insurer, not the loss adjuster. It is to them he should be complaining.1

Clearly more to this story than told, the key fact is what reason they declined to pay?
Did he have business cover?0 -
It didn’t turn out to be very secure4PostLift said:looking for info regarding insurance refusing to pay out on my sons stolen vehicle, vehicle stolen from secure parking area in Manchester while he was working abroad, case was sent by Insurance Company to Loss Adjuster who refuse to reply to lawyers letters therefore we cant go to Ombudsman, how can we take this further0 -
I'm going to take a wild guess here that he left his keys with the parking company, the car was removed using the keys, and so the insurers are pointing to that clause in the insurance.
If that is the case, then his claim is against the parking company, not his car insurer.3 -

Or maybe he ticked the box saying his car would be parked on his drive overnight?1 -
car was parked in secure parking area of flatted property and code required to gain access, however security access barrier was inoperative he was paying £100.00/month for bay. no keys left in vehicle nor with anyone. As he was working abroad it was deemed that he had abandoned the vehicle, however this was his office space0

1. What is a "flatted property"?4PostLift said:car was parked in secure parking area of flatted property and code required to gain access, however security access barrier was inoperative he was paying £100.00/month for bay. no keys left in vehicle nor with anyone. 2. He was paying £100 per month for parking. If the security barrier wasn't working why isn't he suing the parking provider for breach of contract/theft of vehicle?
3. Is this "secure area" where he had told his insurers the car was usually parked?
4. What do the T&Cs of his insurance policy say about "working abroad" and abandonment? eg had he been abroad for too long and the vehicle deemed abandoned?
5. He was using the car as his office space? Did the T&Cs of his insurance permit this?0 -
Have the insurance company pointed to any clause in the policy that they are using to deny the claim. Without knowing why they are refusing the claim it is difficult to advise how to proceed.0

Are you saying that he left the car parked in a bay (for which the charge is £100 per month) at the office where he normally works?4PostLift said:car was parked in secure parking area of flatted property and code required to gain access, however security access barrier was inoperative he was paying £100.00/month for bay. no keys left in vehicle nor with anyone. He then went away to work abroad?
While he was away, the management company for the office / car park (I assume the same management company) thought the car had been abandoned and acted appropriately?
When he got back, your son found the car gone and claimed it as stolen?
Is that what happened?
How long had he gone away for?1
