Private Parking charge

My 17 year old daughter has received a parking charge from Horizon Parking for overstaying at a Tesco car park which has a McDonalds on site which she visited.

The parking limits users to a 90 minute stay which she exceeded by 3 minutes.

The visit was on 26 August and the issue date for the parking charge was 3 September.

Reading previous threads on the site I believe that Horizon Parking charges are not POFA compliant and that this charge has been issued too early for keeper liability to apply (no windscreen ticket was issued).

Also, is there still a grace period that applies to these charges as I'm thinking 3 minutes may fall within any grace period that applies.

It is several years since my family has received one of these charges and I'm aware that legislation changes so I would appreciate any advice from forum users before we respond to Horizon.

    Horizon have been better recently with their compliance with the POFA the NTK has not been issued too early I think you are getting mixed up.
    The should be a 10 minute grace period to exit the car park they cannot issue a PCN for three minutes, but of course you are dealing with scammers.

    3 minutes would also be de minimis.

    Which Tesco? Is it one of the daft ones that has half blue and half green signs?

    If the charge was issued on the 3rd of September, you're already outside the 28 day appeal window.

    First step should be a complaint to Tesco management, especially if the time on site is under 100 minutes.

    I would also try making the usual keeper appeal denying liability but it may be too late in which case simply ignore them unless they send a Letter of Claim and keep them updated with an "address for service" if the keeper moves within the next 6 years.

    Should still be fine to appeal with it being horizon

    Yep I would appeal as keeper today.

    Some BPA firms allow 28 days plus a few days for service.

    However the PCN is NOT for being 3 minutes over. That's impossible and not the reason.

    I am sure @Coupon-mad is correct, @JoeBloggs22 what exactly is the wording given on the NTK?

  • Thankyou for the comments and feedback; I'll answer the points raised.

    The Tesco in question is the Tesco Extra at Copdock, Ipswich. 

    I visited the site on Sunday. The time allowed to park on the site at the time the driver was there is 60 minutes, not 90 as thought, so the grace period does not apply. The car park only has blue signs, no green ones that I saw.

    The NTK was left sealed until the end of last week when it was finally opened by the keeper!!

    As James mentioned, I'll be trying Plan A hopefully today and will let you know the outcome.

    Before I engage with Horizon I'll upload a redacted copy of the NTK and would be grateful if somebody could confirm if its POFA compliant.

    So it sounds like she was there for 93 minutes on a 60 minutes car park,  possibly a Tesco car park,  or a retail park or shopping centre car park that has a Tesco extra

    You must educate her into being extra vigilant when out in a vehicle and to always study signage,  ESPECIALLY on private car parks or private property

    I think she has been taken in by the Tesco Horizon new parking scam where three different parking periods are quoted on the signs. Typically like this:


    But the signage will be deficient it always is with Horizon and I am sure that the the correct entrance signs will be missing all together

    We prefer posters to see it for themselves.

    The POFA version is shown in the NTK pictures thread and it's all about the top paragraph on the back.

    The non-POFA version has a different top back paragraph, see how obvious this is that they aren't claiming keeper liability if you have this version:
