We are doing the comments on the popla euro car parks evidence, basically explaining that payment failed but we had no indication etc.. Is it bad to simply add on to the end that shoud this appeal fail we are not going to be paying and will gladly defend this in court ?0

I can't see any holes in their evidence, they do say payment failed but all the signage and pofa seem sound0

update.. after a couple of dcbl begging letters I fired off a complaint to the management of the shopping centre. I recieved a fob off email basically saying that ECP manage the car park and its not the managements responsibility. I emailed again and pointed out that they need to look at the evidence ecp had sent me as it contradicted what they were saying about payment being attempted. I recieved this reply back:
Hi XXX
Thank you for sending the below evidence.
I have investigated this and as I can see that a payment was attempted, I have requested for the PCN to be cancelled.
Let me know if you need any further assistance.

yes, I should have done it first of all ( i guess thats why its called plan A)
Reading the email is it safe to assume it will be cancelled or do i need to hound them for a written cancellation?

The email says "I have requested for the PCN to be cancelled" I'd hound them for one that confirms "the pcn has been cancelled" OR check on ECP pay pcn payment site, enter your details see how much £ it says is due if £0 take photo.
