DCB Legal £9,000 Smart Parking Claim – Need Help Fighting Back

Yes I have resent the email and addressed it to David Croot, thank you.
Can anyone give me some guidance/clarity on my last post?
Apologies if I am not grasping the process entirely and what each step entails, I just want to make sure my defence is clear before I submit it alongside my N244 as well as the N181 which I plan to submit all at once via email. EX160 completed as well as direct email to DCB for confirmation on their employees authorised to act as litigators.
Thank you0 -
You submit the n181/180 separately. Its to a different email address1

No the only relevant thing you have mentioned is the signage issue anything else is not relevant. That is factA4BZ said:The N244 is an application to log an amended defence so I assume I attach my amended defence alongside the N244 as I attached in my
previous post for you.
I do not understand this process and unsure if you mean I should simply log the N244 requesting to file another defence (as my partner or on his behalf) and await their response, what happens after they process my N244, would I not need to file another document to them outlining my defence or they would request I file this via the MCOL again?
Whilst you stated a lot of the information as ‘waffle’ it has relevance to why PCNs would have been missed due to address changes and extenuating circumstances alongside at the time. I have also mentioned lack of clear signage as well as a lack of evidence put forward regarding said PCNs and their grossly inflated value. I’m not sure what else I could file alongside this.
You log the new defence with the n244 form
Again all done in your partners name using their prison address.
You never answered my question about the remortgage issue.....

Signage as well as movement of addresses and extenuating circumstances including his brain injury leading to a loss of comprehension of basic ways to adhere to rules in life is the only reasonable defence I can concoct at the moment.
I am not sure what other angle I can come from to defend my partners case in this. It’s a church car park opposite a gym he used to attend daily and it is adjoined to a commercial office car park but are designated for separate usage. Our mortgage is due for renewal May 2026 and I will have to stay with our current lender due to my partner being imprisoned and only single household income. The property has had a restriction order placed on it by the police so we cannot sell or transfer ownership as my partner has an ongoing proceeds of crime case which could go on for another 12-24months before it is concluded.1 -
Are you able to even remortgage with such a restriction in place(with the current lender) or you will just drop on their variable rateA4BZ said:Signage as well as movement of addresses and extenuating circumstances including his brain injury leading to a loss of comprehension of basic ways to adhere to rules in life is the only reasonable defence I can concoct at the moment.

I would ask this question on the mortgage board. There are mortgage advisers on there who can give you a straight answer
If there is a POCA hearing due then personally id say this claim could be the least of your worries
@Coupon-mad @troublemaker22
Can you help on this? (with the defence /application part)1 -
In my day (I was a mortgage manager once upon a time) staying with the same lender - same amount borrowed - and just renegotiating the interest rate/product wasn't actually 'remortgaging' so it should in theory be OK. But that was 35 years ago so that is a question for your lender. Not me!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I changed from one fixed rate mortgage product to a new fixed rate mortgage product with the same lender this year and it wasn't classed as a remortgage, I just told them which deal/product I wanted to go to and they did the rest without any of the conveyancing and legal stuff that comes with a remortgage (and I work for a conveyancing firm now as well).Coupon-mad said:In my day (I was a mortgage manager once upon a time) staying with the same lender - same amount borrowed - and just renegotiating the interest rate/product wasn't actually 'remortgaging' so it should in theory be OK. Yes my partner has a mortgage broker he’s used for years and renewing the mortgage won’t be an issue but we’re forced to stick with the same lender, either way we’ll be saving PCM as our current rate sits around 5.4%.
POCA is in hand as well, he has police corruption on his case for a substantial amount of cryptocurrency so he’s handling with court orders for exchanges where the police cashed cryptocurrency out of after seizing it and failing to disclose, he’s got 1 foot on their necks. I just want to help us handle this situation now.
If anyone such as @Coupon-mad or @troublemaker22 could assist me further with the defence I’ll submit alongside my N244 I would really appreciate it.
Thank you all again.0 -
You really need to have done this by now
Personally given its smart parking i would base a defence on no keeper liability given they are all non POFA.
Do a concise defence based on the fact there is no keeper liability and to put them to strict proof of who the driver was.
There isnt really a lot of other options now
Please get it all submitted this weekend. I would then submitted the allocation form 10 days later. Each to their own relevant email addresses1
