As your partner is in prison he will be entitled to help with fees. So I would make an application on his behalf (as him) to log an amended defence. (As it wont cost anything) you may be lucky and the defence will strike out your unsuitable defence but get the ball rolling by getting an application done. Help with fees is done on the .gov website.Good advice.

You have not answered my questions about how long he has left to serve. As that impacts the address that needs to be used

Thank you all again.
Please see attached initial form sent from CNBC who actually boosted the costs up due to court fees etc to 12k or so. My partner appealed this on his government gateway ID via MCOL and I have access to his emails but have been unable to reset his PW. Every time I do a password reset and it seems successful it sends me to the gov.uk site ‘Make a court claim for money’ and doesn’t give me access to his MCOL account. We actually have another defence filed on my MCOL account with DCB Legal for the same carpark around the same time, this one for £699 or so. I have attached pictures for clarity.It also stated too many government gateways are linked with this email. So I am not sure how I can gain access to review the defence we filed at the time but he told me he filed a defence plainly on the basis of his incarceration and extenuating circumstances, not having a recollection of receiving the original tickets in the post.
I have attached a picture of what seems to be the mediation services I located, shall I contact them asap or have I found the incorrect service.
We cannot afford any additional outlay for legal representation on this. I saw mention of applying for help regarding fees, I cannot afford even a substantially reduced fee for assistance or by fees are you referring to the overall cost of the claim?
My partners current release date is January 2028 and he has been away since February 2024. It seems logical to mention this in my response to the N181 directions questionnaire once the court officially sends it over to me. Would I inform them of the address change and to contact Andrew in prison? Post may get missed on the way to him and I don’t want to be in a worse position because of that or an officer failing to deliver it etc.

Mcol has detached itself from the government id. Its quite common
So please follow my advice. You must do a help with fees application. This has already been explained and it doesnt need to be re explained
I ve already said ditch thr inadequate defence (it is not and has never been an appeal
So go back to my post and follow it please
Write a letter not an email to dcb legal as him with his current address with his prison number on it
And the fee is the fee to ditch the irrelevant defence thats been logged and replace
So come back when you have done . You will in an n244 form. Do the help with fees first and use this forum to put a proprr defence in as him
When the claim is updated to the prison address you have no real worry
But the main thing is actually follow the advice ive already given

Give the sums involved there is another way round this
Now this depends on your income level and if you are able to re-mortgage (as you mentioned this) the house on your income as it is
If you are , what you could do is get the house remortgaged on your own and get him removed from the deeds as part of the legal work involved when the conveyancing process is undertook
If that is possible then when hes off the mortgage and has no assets then all this debt can be wrapped up in a DRO
But thats just something to think about2 -
I would be applying to get this claim stricken out - and it's a near certain guarantee it will be.
Claiming for 53 PCNs without any attempt to elaborate is the ultimate defective POC.
Not to mention the breach being pleaded - Unauthorised parking ?? WTAF is that?1 -

The POC may well be defective but this isnt a simple situation
D Is in prison . Now in prison he could attend a video hearing but everything is 10× as difficult given D is a guest of HMP service

Get the claim moved to the prison thats half the job done

There are many ways to skin a cat in these situations you just have to think outside the box. Trust me there is more then one way of dealing claims even of this size
