Hiya all
anyone know what the rules are with cancelling a PCP agreement before car is delivered or finance is in place?
short story is I was hard sold a brand MG HS and they took 2k initial deposit 6 weeks ago but still no new car and no date when it will be here
can I cancel this deal and get my 2k back
I have not signed for the finance yet and no credit searches have taken place

What do you mean by "hard sold"?paulsos1971 said:Hiya all

How did you order, in person or remotely?
What have you signed?
If you have signed an order form what do the Ts and Cs say regarding delivery dates and cancellation?
1 -
Read the paperwork you signed, and have a copy of.
Was the car you ordered in dealer stock, MG UK stock, or factory order?3 -
By hard sold It was 4:20 Pm on a Sunday and they were closing in ten minutes, salesman said he can only do the deal today and it would be off the table tomorrow.I was in the showroom and had just completed a 10 min test drive
I signed an order form only which states 30 September delivery which I have only just noticed, when I test drove the car he said it’s UK stock and I can have it 1st September when the new 75 reg roles out
the T&C are to small to read, I will try and take a picture to show
update but easier to read on a photo than the actual doc, what would be net costs?0 -
Why do you want to cancel? As above if delivery was critical by certain date you should have raised at the time.0
-
In the absence of terms and conditions which you haven’t posted yet, you’ll be £2000 out of pocket if you cancel. That’s what a deposit means (unless the ts and cs say different) Why don’t you ask them?0
-
Here’s the Ts & Cs, I think its section 8

Suggests they will refund you but may not be the whole amount
I'm struggling to read that though as it's quite blurry4.29kWp Solar system, 45/55 South/West split in cloudy rainy Cumbria.0 -
Yes. It’s blurry, but says they will refund you less costs they’ve incurred - so sooner you cancel the better. There will be less costs if it’s a standard spec model. But you’ll have to ask them the amount and then weigh up if it’s worth cancelling.0
-
If the deal was so good that you bit their hand off at 1620 on a Sunday why are you thinking of cancelling?2
-
I’ll give them a call tomorrow and see what the charges are.
on reflection it wasn’t such a good deal and I didn’t exactly bite there hand off, I should have known better at my age and walked away to think about it0
