If you did not admit to being the driver all of what you have written is irrelevant. You state bo defences seem suitable. They are all suitable if you didnt admit to being the driver
For most smart parking court claims the last thing you want is a description of what happened on the day1 -
No. Do not admit to driving (unless you already blew that point in an earlier appeal?)

Copy and paste an 11 paragraph Smart Parking one, verbatim. No changes.
This will have to be my final advice for you at this stage as we do this in our own time and with the best will in the World, we regulars can't keep repeating this same stuff again and again on thread after thread.

I might have admitted to being the driver on my POPLA appeal, which is why I wanted to use the misleading signs for the payment not being made.
Are you suggesting that this approach won’t work?
I guess I could always add that I don’t remember being the driver. My wife hates being a passenger so usually drives. I will also check what I wrote on my POPLA appeal as I still have a copy of that.0 -
Sorry I missed your reply. The date of issue is 25th November and I did the AoS the day I got my letter in the post. I have a feeling I should have waited a few days, but it’s done now.Le_Kirk said:

Or use the new version posted yesterday in the Smart Parking DCB Legal group info thread (which we don't need to link because you can easily find it on page one or two of the forum right now).
In fact, ANY version will work.

I can understand it must be annoying for you having to repeat the same information regularly. Maybe it's worth editing the advice for section 3 of the template defence linked in the newbies tread as I read that first here:

That advises "that paragraph 3 is yours to write", which is what I did. When you told me to just copy another section 3, the different advice confused me. I'm just thinking that changing the advice on the above link could nip some of these repeat questions in the bud and save wasting your time.
Just a suggestion anyway, I hope you don't mind. I really appreciate all of the information here and the help you all provide.2
