    Ok, the claim form has arrived in the post. I haven’t read through it yet but will take a closer look this afternoon.

    Any advice for what to do next would be greatly appreciated. 
    What is the date of issue of the claim form and when are you proposing to do the AoS?

    There are now over 35 Smart Parking linked court defence threads in my post on Page 14 of the Consultation thread that I linked for you earlier in this thread. All exactly the same.

    Thank you. The only bit I'm typing is section 3 of my defence. The rest is copied from the template.

    My section 3 is about the the unclear instructions leading me to pay with the wrong parking app. Is it ok to copy it on here to check the wording and advise of anything I should change.

    Surely I need to modify this bit don't i?

    You were asked to read a few recent Smart Parking,  DCB LEGAL cases on here and copy the best paragraph 3 that suits your individual case, adapting paragraph 3 as required or necessary,  then add your finalised paragraph 3 to the other 9 paragraphs in the template defence,  replacing the current paragraph 3, and adding the extra paragraph 4 if you never revealed who was driving,  making 11 paragraphs 

    I even linked an example for you

    My goodness we need a Smart Parking defence group thread to stop new threads. This is like Groundhog Day every day this month (not your fault - no criticism of you).

    Thank you. Apologies if I'm coming across as dim, but I've tried looking a several Smart Parking cases and I can't find a suitable one to use. I wanted to include details about how unclear the signage was and how it lead me to use the wrong parking app, so I tried writing my own section 3.

    3. The Defendant attempted to pay, but unclear instructions to download the payment app lead to the wrong app being used. Instead of clearly showing the correct website to use, instructions to ‘Use Ringgo Apps’ were displayed, suggesting more than one app could be used. Below that there were symbols for Apple, Android, etc. so the Defendant searched the app store on their phone. The app store didn’t show one called Ringgo, but ‘Your Parking Space’ was top of the list, suggesting it could be used. Also the name of the car park that has been mentioned on all correspondence to the Defendant did not appear on the sign, making it impossible to identify  the correct name of the car park on the app. The Defendant has the receipt of the payment made and the installation date of the app on their phone match the date of the parking charge. These can be presented at court to prove the defendant attempted to pay. The claimed sum is grossly inflated, as no private parking charge can lawfully amount to £170.

    Sorry for not copying and pasting another, but it's an accurate reflection of what happened on the day. This is my first time doing anything like this so I want to get it right. The rest of the defence is copied from the link Gr1pr gave me.
