EV parking bay not clearly marked

Unsurprisingly, my appeal to UKPC was rejected and I'm in the process of doing the POPLA appeal. Do you think it worth appealing to POPLA or just ignore the appeal and wait for the possible court action?
My main argument is that the driver parked in a bay (in a shopping complex) that was not marked as an EV charging bay. The bays themselves are most often clearly marked and sometimes coloured green or different from other bays. Furthermore, although there is a sign stating parking for electric vehicles whilst charging, it does not specify exactly which bays. See photos below. The driver was parked in the one pointed to with a pink arrow.

    Its probably worth trying and adding your evidence pictures,  based on poor and inadequate signage,  especially the bays and the offset charger. It seems to me that either bay could be used to charge an EV

    OTHERWISE it's forbidding signage to a non EV vehicle,  no parking contract offered 

    What happened to plan A  ? The complaint to the retail park management company or landlord or landowner   ?

    Thanks, yes I'll be submitting all the pictures as evidence.
    The driver tried unsuccessfully to get Sports Direct to cancel the PCN.

    Never too late for plan A , preferably before the popla appeal is submitted  (otherwise I wouldn't have mentioned it)

    Hmm, looks pretty obvious. Sign, EV charger, both in bright colours. 

    You can probably get out of paying it, but please pay attention and don't block EV chargers with your fossil.

    That sign is incorrect,  it says Penalty Charge Notice,  not allowed on private relevant land,  or signs,  or pcns

    Its also not a UKPC sign, so cannot be used by UKPC , it's an Osprey sign

    Its another appeal point

    Can you get a readable picture of the Welsh and the English UKPC sign? And take a tape measure and photograph how high the bottom of the English sign is?

    By putting one above the other I think they have marginalised - and made it impossible for themselves to form contracts with - English speakers because it looks like those terms are unreadable even if standing underneath.

    Get a photo from the EV bay pointing at the UKPC signs and them one standing under it looking up.. I bet the £100 cannot be seen. And get one with the tape measure showing the height of the English sign. 

    That evidence potentially wins at POPLA and you have over 30 days to use the POPLA Code. Not just 28 days: it's actually 28 plus 5.

    So put POPLA off (assuming the Code isn't a month old) while you go get that evidence.
