SMALL CLAIM RECEIVED FOR PARKING - BUT THE CLAIM COULD NOT BE FOUND ON MCOL

Hi everyone ! I received a CCJ claim form for parking of a vehicle I do not own and have not driven. Infact I do not even know which vehicle it was. Since it was a legal notice, I submitted the AOS. I took a lot of time to prepare a defence but when I tried to submit it online via MCOL, I could not log in using the Claim number and password provided in the pack. Furthermore, on checking the claims history, I could not find that claim at all on MCOL website.
Does that mean, claimant has removed the claim from the court ?
If yes, can I press charges against them for stress and wasting my time ?
The claimant were UK Parking Control via DCB Legal.

    It sounds likely that the claim has been withdrawn but I would check with the court clerk.
    You can't have taken much time to prepare the defence.  The defence is simply that you have no knowledge of the vehicle and certainly haven't driven.
    It sounds like the robotic parking companies have just blindly followed processes and now that they're on the verge of a court appearance...they are realising that they have no case against you.
    If you can prove the amount/value of time that has been wasted and can prove that you've spent £x on counselling due to the stress/anxiety then you could try to make a counterclaim.  However I think this would double your stress so it's not something I'd suggest.

    Definitely not a CCJ,  Just a Money Claim from the CNBC in Northampton using MCOL,  no court was involved at that time, just the claimants lawyers,  you and the CNBC  ( court was or is months away   )

    You could phone the CNBC helpline,  preferably early morning when it's not as busy, give the claim reference number and ask for a verbal update as to what stage it's at, if any,  or if its been discontinued or withdrawn etc

    You could try a claim,  paying the initial fee, but probably doomed to failure based on the details so far 

    Any counter claim is submitted with the defence and payment of the fee at the same time, the minimum is £35

    This is a glitch reported several times in other threads.

    The first answer you received was from a poster who posts unhelpful replies on this board, criticising the consumer. Don't be put off by that reply (which has an element of that, by saying you can't have spent ages on your defence. These things DO take ages for frightened people to research what to do). Your defence should be the Template Defence.

    Show us the POC.

    What was the Issue Date?

    When did you do the AOS?

    Which solicitor and which parking firm claimant?

    Could it have been a car you leased or hired?

    Or do you have a common name and the debt crawlers have mistraced the right person as you in error?

    Please come back. The claim hasn't gone away and you must defend it.

    Thankyou so much for your helpful replies. The claim was made by UKPCL and theri solicitors were DCB legal.

    It was issued on 07 Aug 2025 and I sent the AOS on 24th Aug. 

    i did not hire or lease the car. I think it must be a common name and they sent the notice to the wrong address.

    Now, when I log into MCOL website onto my account, I can't find the claim and in claim histories, it says 'no recent claims'.

    And @Coupon-mad you are right. I was actually very anxious and frightened to prepare the defence even though I had no connection with the vehicle. I did consult a solicitor and searched a lot before compiling the defence. But anyways, I think it would not be worth making a counterclaim as it would give me more stress. I just want to be sure that there is no existing claim against me. I will call CNBC to confirm this.

    Oh dear. You are now several days late putting the defence in.

    You are chancing a CCJ even over the weekend because all it takes is the push of a 'request default judgment' button by DCB.

    Right you are going to have to email to the CNBC, a defence signed under a statement of truth, and saved as a PDF.

    See the Template Defence thread RIGHT NOW, which gives you the defence (except para 3 but you add something concise there about it not being a vehicle you recognise or have ever owned or driven so you believe DCB group has mis-traced the real defendant, plus YOU MUST ADD THE STATEMENT OF TRUTH AND SIGN & DATE IT AT THE BOTTOM) and it gives you the claim responses email address

    Thankyou for your very replies. 

    It looks like luck is not in my favour. I had a couple of unforeseen events in my life which completely shifted my focus from all the other things going around. 

    You guys were absolutely right. Having a claim removed from MCOL website did not mean that it has been erased completely. I should have submitted the defence anyways which I could not and did not. 

    Today I received a judgement from the County court. 

    You will be well aware that there is an option of filling out an application form for setting the judgment aside by paying fee of £313 and by going to a private hearing, which I will do definetly. I will also fill out an application form to send to DVLA for getting a proof that the vehicle mentioned in the parking fine does not belong to me. What a waste of time and money this is. For something which I have never done. 

    After the judgment has been dealt with, I will sue DCB Legal even if I have to hire a solicitor and it costs me a fortune.

    Any valuable suggestions here will be highly appreciated. Thankyou.

    Hang about.

    DO NOT go back to that solicitor. Let's think about the best line of attack, given this isn't your car and there are posters here with ten times more knowledge than a random solicitor with no parking law specialism.

    Ofcourse I will rely on advice from posters here as I previously have overturned a small claim from DCB legal using the advice from this forum. 

    I should fill out the form and pay for 'setting aside the judgement' anyways ? The ccj was issued on 16 Sep. I just got it yesterday.
