Can my insurer cancel the claim and repair?

I’ve had a subsidence claim on my property that I reported over 2 years ago. The insurer appointed a company to monitor and carry out repairs, but this has now dragged on for more than 27 months. It feels like they’re delaying the process as much as possible to avoid paying for the repair.

The situation is becoming urgent because I need to move out. My concern is that the insurer may be hoping I’ll either sell the house or vacate it without selling, which I don't know if that affects the claim.

My question is: can the insurer legally cancel the claim or refuse to carry out the repairs in either of these scenarios?

  1. If I move out but remain the legal owner of the property.

  2. If I sell the house, would the buyer inherit the benefit of the ongoing claim?

Any advice or experience would be appreciated.Thanks!

    A 27-month period is not unusual for a subsidence claim.   The monitoring for movement often runs into years.

    My concern is that the insurer may be hoping I’ll either sell the house or vacate it without selling, which I don't know if that affects the claim.
    Your insurer will have that hope.

    At this point in time, you house is likely unsellable to anyone that would need a mortgage as a lender valuation would flag the unrepaired subsidence.

    1 - no
    2 - as the house would likely be unsellable, that issue is unlikely to rear its head.

    You would have been better off posting in the insurance section rather than the missale section as your query doesnt apply to misselling and many of the posters with strong insurance knowledge don't come to this section.

    Not sure what you mean about the 'misselling' secion, I am seeing 'Reclaim PPI & other insurance' so I added there.

    Can an admin please move this to the appropriate secion?

    The reclaim is the misselling section. i.e. reclaiming your premiums because it was missold.

    Can an admin please move this to the appropriate secion?
