Seventh Anniversary First Post Combo Breaker
I received a pcn from Met parking for not validating my ticket when getting KFC at Gatwick March 2024 I don't remember any signs but they have them now and the staff didn't say anything and when I tried to leave the barrier wouldn't open so I think I pressed the only button and I have now found out it says press this to exit and basically agree to receive a pcn!

 I argued with Kfc Met and even Popla but they refused and they even boasted they sent 27 pcns out that day so  and now I am at the court claim form stage and I think I now have to acknowledge this at MCOL but would really like some help with my wording please?

    Looks like you failed to redact the claim form correctly,  so redact it properly this time and repost it below 

    Hide your name and address,  VRM details,  claim reference number and password too, so 4 items need to be hidden before taking the picture

    So Met Parking via DCB Legal,  issue date 21st August,  failure to validate stay in car park 

    Login to MCOL via your government gateway account and complete the AOS online on MCOL ASAP following the advice in the newbies sticky thread in announcements,  second post 

    Then start drafting your defence based on the template defence by coupon mad in announcements

    Bet the sign says customers only or similar, so this is effectively a gopping £170 for not typing in a reg number somewhere. The primary obligation (to be a customer) is complied with.

    They may find that Beavis can be relied upon by the o/p that this charge is in fact an impermissible penalty. Don't expect them to appreciate that...

    Which is good evidence that their contractual terms are not clear enough.

    Show us that boast please (a screenshot showing it came from MET).

    DCB Legal always discontinue so copy any MET defence posted recently, in the last month; there are loads if Stansted ones which would work for your case too..

    DCB have lied about the POFA applying at an Airport yet again. Did you include that point in your defence?

    And just a reminder even though this is stressful: before the end of next week please please do the government's Public Consultation that you have surely seen posted about on every claim thread.

    Very good, although when complaining to an MP, constituents are required to complain to your OWN local MP.

    27 is a very, very high number of people 'failing to validate'. They should not be boasting about that number. It's indicative of non-prominent t&cs and a hidden keypad. Not something to be proud of; parking firms have lost sight of reality.

    And they don't say how many vehicles visit that KFC every day! Even if that number is 500 a day (seems unlikely 500 people would visit there by car each day but imagine if it was) then 27 is over 5% penalised.

    That's a very high percentage to get parking charges in a site where motorist patrons are invited to enter.

    The industry like to trumpet that 99.7% of parking events do NOT result in a PCN but I believe that study was done by just three BPA AOS members - one was ParkingEye - who all operate at extremely high visitor number sites like hospitals, retail parks and large supermarkets.

    That's correct,  all complaints must go from the constituents to their own local MP first,  even if it is then passed on to another MP or department
