    That's not a counter claim, its a Costs assessment statement to submit to your local civil court along with your WS

    DEFINITELY NOT a valid reason for a counter claim at the defence stage

    Hi all,

    Got court on the 7th, everything’s all submitted and just working on the last little bits for the day. Anyone got any pointers or tips to help sway the judge on the day?


    Basis of the claim is a free car park at a doctors surgery for patients. Validation is required, my validation didn’t go through, my own fault as I rushed due to being called for my appointment but now hit with £260 claim.

    Any pointers greatly appreciated as you all know a lot more than me!

    Name the private parking company claimant involved and any lawyers

    What is the hearing fee deadline ? Have they paid it ?

    What is your WS deadline as its past that deadline. ?

    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Private Parking Enforcement and Gladstone solicitors.

    I’ve sent my WS but haven’t had anything from Gladstone, deadline is tomorrow at 4pm, unsure if they’ve paid the fee. Hopefully they miss the deadline and so that puts a stop to it.

    So, you should have posted the above on your previous thread, to save us asking questions that weren't needed

    All your threads need merging into one by the admins, so report it as such using the red report button

    Phone the court on Tuesday to see if they paid the hearing fee

    If you receive the WS late, raise it as a preliminary matter at the start of the hearing, asking for it to be struck out, same as the other recent cases on here

    If this is the same case then the particulars are amusing. The particulars say the sign was a unilateral offer accepted by parking. A unilateral offer is like a reward poster for a lost dog: the offeror promises, nobody else does, and you accept by doing the act. Someone who does not find the dog owes nothing. Someone who does find it owes nothing either. Only the offeror can ever be in breach, eg by not paying up when the dog is returned. So the Claimant has pleaded a contract in which the driver promised nothing, then sued the driver for breaking a promise. It does not say what term was broken, what the driver did, or what the Claimant gave in return.
