The court is your choice. No worries there. You don't have to come to my neck of the woods again!
But we do ask one favour - in fact you'd be doing all motorists s favour, including yourself:FIGHTBACK ALERT:
Please do the government's Public Consultation. We need every poster to complete this vital survey before the deadline next week.
See this thread:
We understand that you may need some pointers. It looks laborious, we get that. It doesn't matter; no knowledge is needed except re your own experiences so you can call out a scam industry and you'll protect millions of motorists and help change the law.
I've written some guidance to help focus new posters on the issues. I've covered almost every question, providing ideas if you agree with our stance on things like DRFs, which we say must be banned.
Ordinary people like you are falling victim to this scam over 18 million times per annum. Motorists need your voice added please.
CLOSES ON FRIDAY 26th SEPTEMBER.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Is court the only option here now out of interest? My wife (who I think I mentioned was also driving a separate car and got almost identical NTK) is too scared to go to court and doesn’t want anything on her record (not sure there would be record here?). I presume it’s now either pay the £60 or go to court?
also going to do the government public consultation now! Thanks again for everything1 -
Oh!
No no no...please don't spook yourselves by imagining things that don't happen and talking each other into paying to make it go away!
Good people DON'T pay scams. That is not the example to set to family, I always say to unsure friends & family. I'm a mum of four (driver) young adults. NONE would pay a private PCN!
Of course it doesn't cause a CCJ as long as the defendant defends (and that's if you even get a daft Claim form). Defending is easier than any appeal. Almost nobody has a hearing. This is NOT scary or risky. You don't even have a CCJ if you lose (very rare) because the person just pays LESS than the claim. Pay and it's gone. But only if a judge says so.
Do you think Martin Lewis would have approved the re-written official MSE Guide this Summer (linked at the top of the page) saying to ignore the IAS and ignore the debt demands and 'defend if you get a claim' if it affected anyone's credit? This site would never put anyone's credit at risk.
Please read the guide.

Oh wow! Thank you so much for sharing this with us. I hadn’t seen that section in the forums so it’s really reassuring to hear everything you mentioned! We are very very appreciative for all your help and no doubt may respond at the next step if there is one. Thanks again, if there’s a way to give a tip/buy a coffee or a glass of wine let me know!2

All we ask is people fight back by doing the Public Consultation. Takes a whole evening or two but we need to government to realise their options are very weak.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I myself had a bad experience with this carpark (I was from out of town) and was pursued all the way to court by OPS, but I won my case as have many others - some of which I have helped. So all is far from lost. I didn't go to Brighton court, I chose my own local court.
You can appeal via IAS, but it will probably be a waste of time - the house always wins regardless. They are only a trade association for the parking industry and certainly not Independent nor or they legally binding or can make you pay. The next step would be a LBC/ LOC from the parking company's legal partners (the same people who send the aggressive "debt" letters). If and when it goes to court, nobody knows - sometimes they do, other times they pull out last minute and in my case they saw it all the way. Mine should of really been thrown out before it started as they failed to get the papers over, but the judge gave their legal rep another chance - but awarded in my favour.
If you click on my username, you can view the post I started for my time in this car and if you use the search engine you can find other cases here. Most people won their cases in court, sometimes they pulled out last minute and other users didn't come back so we'll never know what happened.
But as you mentioned - phone signals/ receptions are a nightmare in this location - even more so since they introduced their own app. Have a read of the other posts as there will be lots of similarities to your case which can use and learn from as you fight this rubbish.

Thank you so much for the detailed response! We have just received the chaser from ZZPS (their debt collection partners). My wife is scared about it and wants to pay it even though it’s now the £100 fine plus £70 admin fee…95Rollers said:dudebuddypal1234

I’ll have a look through your post now and will drop you any questions. Thanks again for your help. FWIW we think we have pretty obvious mitigation against these charges as we couldn’t get signal and we had our baby with us.0 -
Turning back to you as the guiding light and once again thank you for all your help to date.Coupon-mad said:Oh!

Please read the guide. We have just received the below letters which is a debt collector chasing on behalf, presume these are just to be ignored?I still haven’t made them aware of any mitigating factors (we struggled to connect to the app to pay but eventually managed it with signal and we have the time of when we downloaded the app which matches this, and the overstay of 20 mins was marginal) but presume it’s all too late to make anyone aware of this now and save this for the back pocket if we do get taken to court on it?
thanks so much again, your help is invaluable!
