Vantage Point NTK Parking Charge

Hi - I was looking for help from all you wonderful people who understand this way better than me…

I have received a parking fine for parking at the Vantage Point car park in Brighton for 4 hours 20 minutes.

I arrived with my 9 month old baby for a day out at the seaside and by the time I paid for the parking 20 mins had gone, I then paid for 4 hours parking which would have covered me till the time I got out of the parking lot. I have a receipt for parking which ended within a couple of minutes of the time I left the parking lot.

im hoping someone can point me in the right direction here as I cant afford to pay this £100 fine which just feels incredibly harsh given I’d paid £8.50 for the 4 hours parking already.

any help is hugely appreciated and I can add any blanked pictures of the fine if needed.

    Definitely not a fine,  just a pcn, an invoice,  possibly from OPS  ?  ONE PARKING SOLUTION  , for Insufficient paid time   ?  Exceeding the paid for time   ?  Never use a One Parking Solution car park

    Post a redacted picture of the NTK PCN letter,  hiding personal and private sensitive information but leaving dates and times showing

    Sorry you are right! It’s a NTK. I’ve added a picture below with the key info stamped out. I think there are mitigating circumstances such as only being 20 mins over, taking 10 mins to get my baby out of the car and then the Poppay app not working for 10 mins (other users have experienced this). And it is also not possibly to backdate so I was paying for 4 hours which run out at 18:28 (within 2 mins of when I left the parking lot).

    the PPC was one parking solution.

    OPS aren't interested in mitigating factors,  although the landlord or landowner might be if you complain 

    You redacted the dates and times,  so we cannot deduce anything else 

    The alleged contravention is,  Parking duration not paid in full,  which seems to be correct from a pedantic point of view 

    The only possible chance of you winning based on the information so far is in court

    i figured if I left the times they’d be able to work out who it was quite easily. I’ve re added there. I’ve also added a snip of when I downloaded the app to prove it took 10 mins for it to connect and work.

    and yes I’d agree correct in a pedantic way but it’s impossible to backdate parking so are they expecting people to pay for the parking as they drive in even if they don’t have the app downloaded. All just seem a bit odd and incredibly harsh given we paid £8.50 for the parking already

    I agree with you,  and methods of payment and also payment machines are notorious,  but until regulation comes in we are stuck with it, hence why a good defence and Witness Statement might win for you, plus various other factors

    I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.

    There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle.

    If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.

    If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner.“

    I’ve just received the following letter, I’ve read the newbie thread which suggests do not appeal to the IAS and that next step is court. Just wanted to double check. Would the court be in the area of the parking charge or would it be local to me? Because I’d spend the money in petrol getting to Brighton court that it would cost me to pay the fine.

    i still believe I have strong enough evidence in the fact that the app wasn’t connecting to the bank in the first few attempts and I downloaded the app within 10 mins of parking. Also that I left the car park less than 5 minutes after my parking I had paid for cake to an end. Is it worth me responding with any of this now? I’ve still not made them aware of the driver yet so I guess not

    any other help is appreciated as always!
