dcb legal Letter of Claim no PCN Received
I have read through the newbie section and intend to send the 30 day letter, but have a query about my specific scenario.
I have received no PCN's and no correspondence to date, although I did change address about 1 month after the alleged parking. I also have evidence on my bank statement that I paid by card at the payment machine (but the date the money ;left the account is the following day. I can prove that I was in a different part of the country on the following day, so the payment must be for this parking.)
The letter of claim from dcb legal alleges that "No valid pay and display permit was purchased"
DCBlegal are instructed by Euro Carparks
I am wondering what I should do next - in the light of having paid and the absence of any PCN's or other correspondence. Do I write and say "I paid here is proof?", do I ignore save for the 30 day letter?
Thanks

Wait for the 30 day notice LOC before sending the Template reply. You must get your address updated
DVLA V5C and driving licence.
Email Euro car parks and DCB Legal DPO a Data Rectification Notice. INSTRUCT them to ERASE your old address and replace it with your current address for service. Find DPO email in privacy policy on their website. See NEWBIES post 4 change address.2 -
Thanks, that is what I was going to do. I am wondering whether to say anything about having paid etc?Nellymoser said:Wait for the 30 day notice LOC before sending the Template reply. You must get your address updated

Yes you can say the parking was paid for so you want to know whether their client is alleging a VRM typo (keying error)? Or are they saying a payment was made fir the right VRM but the car overstayed paid for time?
Do that by email to DCB Legal.

I have had a reply from DCB (set out below)
What is the next action? Help appreciated. Payment was made, we think its probably registration misskey, as a payment to Euro Carparks left the account the next day. problem is that its not the same day.Dear XXXX,
We write in response to your correspondence received in our office.
We now respond to the same as follows.
Our Client applied to the DVLA for the details of the Registered Keeper of the Vehicle. Your name and the address XXXXXXXXXXX were provided. Our Client therefore correctly issued correspondence to you at that address. Having not received payment, address verification was carried out prior to the Letter of Claim being sent. Your new address was located and as such the Letter of Claim was issued to you at the traced address.
In accordance with the British Parking Association (BPA) Code of Practice, where the Parking Charge Notice (PCN) becomes overdue and before Court proceedings have commenced, a reasonable sum may be added for the debt recovery fees. The correct recovery fees have been added and will not be removed. As such, the outstanding balance of £170.00 remains payable to prevent further action. The HMRC ‘VAT Supply and Consideration manual’ (VATSC06140), which was last updated on 02 September 2020, confirmed that parking charge notices falls out of the scope of VAT.
In relation to the comments concerning damages, the sum added is a contribution to the actual costs incurred by our Client as a result of your non-payment. Our Client’s employees have spent time and material attempting to recover the debt. This is not our Client’s usual business and the resources could have been better spent in other areas of the business. Had you of paid as per the Contract, there would have been no need for recovery action so the amount due would not have increased.
You now have 30 days from the date of this email to make payment of 170.00. Failure to make payment will result in a Claim being issued against you without any further reference.
Payment can be made via bank transfer to our designated client account: -
- Account Name: DCB Legal Ltd Client Account
- Sort Code: 20-24-09
- Account Number: 60964441
You must quote the correct case reference (XXXXXXX) when making payment. If you do not, we may be unable to correctly allocate the payment. If further action is taken by us as a result of an incorrect reference being quoted, you will be liable for any further fees or costs incurred.
We would ask that you kindly furnish us with your most up to date telephone number, this can be emailed to us at info@dcblegal.co.uk.
Alternatively, you can contact DCB Legal Ltd on 0203 838 7038 to make payment over the telephone or online at XXXXX

Ignore them and wait for the inevitable N1SDT court claim pack from the CNBC in Northampton using MCOL to arrive in the post
Defending the court claim is your best option1 -
Hmm - don't want to use up time faffing about with court claims. Work is very intense at present. I guess it depends whats involved in pulling together a defence0

Its already been written in announcements near the top of the forum, have you read any ?
They will discontinue next year, before the hearing fee is due, same as the other 675 or so in the discontinuations thread by Umkomaas, have a good read of them
I bet my young granddaughter could easily defend a claim with our help ! And she's at primary school1 -
I have read off of the newbie stuff. Not sure where announcements are, they don't show when I come to the thread via my profile0

Go to the MSE main forum menu, not your profile , and click on the forum marked , Parking tickets, Fines and Parking
There are 7 announcements right at the top of the parking tickets forum, study the newbies sticky thread in announcements and also the defence template thread, first 2 posts
Plus if you read the coupon mad reply above, in her signature she highlights how to navigate to the parking tickets forum, and highlights it in blue font , it's at the bottom of her reply to you2 -
Absolute cinch. It's easier than appealing! No work involved, no hearing, no cost, no CCJ risk and we have a template defence.blueg33 said:Hmm - don't want to use up time faffing about with court claims. Work is very intense at present. You'll never pay.
They'll discontinue in 2026. Scam over.
Please don't come to your thread via your profile. That means you see nothing else! See my signature for where to click:PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
