UK CPM Parking Ticket Dispute – 10 min of van loading

Hi all, I would like to ask for some advice. It seems that some newly built parts of London have parking managed by a private company called CPM (UK Car Park Management).

I recently received a PCN from them for £60 for being parked for 10 minutes. I explained and provided proof that I was collecting from a customer who lives there, but my appeal was rejected on the basis that “the vehicle remained on site for 10 minutes with no permit to authorise your stay.”

I now have the option to appeal through uk-carparkmanagement.co.uk, which looks like just another “in-house” process.

As they are members of the British Parking Association (BPA), I asked them to provide a 10-digit POPLA code so I could appeal further. They replied that although they are BPA members, “we are not part of their Approved Operator Scheme (AOS) which deals with the issuing of tickets on private land.”

Instead, they explained that they are members of the Accredited Trade Association (ATA) called the International Parking Community (IPC) and therefore follow the IPC Code of Practice, another organisation with very poor reviews online.

I can see this company is mentioned on this forum quite a lot, but I’m unsure what the next steps should be. If they decide to take this to court, do I stand a good chance of winning?

    These cases are well known on the forums,  you were stopped whilst collwcting and loading,  so not parked  !

    They are correct,  no popla code because they are not BPA AOS members,  probably haven't been for a decade,  they are IPC AOS members,  so use the kangaroo court of the IAS 

    The code of practice is a joint Code with the BPA and has been so for several months,  2 trade bodies but a single code

    They may not take it to court,  but may well issue a court claim against you,  in which case your explanation plus the Jopson case should assist you towards a successful outcome

    99% of claims here are won by Defendants or discontinued or struck out by the courts. This has been consistent for a decade.

    No worries. No CCJ risk as long as you don't move house without telling them, or fail to defend a claim. In your case it is defendable. Loading or unloading is not parked.

    But our experience shows there is no appeal that isn't futile. You mean the IAS don't you, so either ignore the IAS stage or try it, to expose that it is a complete kangaroo court.

    We are of the view that people should be exposing the IAS for what it is and we need more evidence for the Government.

    Did you know that the IPC and IAS are both owned by Uniti, all owned/controlled by Will Hurley Ltd and a couple of years ago, he also registered a commercial Ltd company called The Independent Appeals Service Ltd with himself as the sole director? Even though he also runs the trade body:

    The Ltd company is waiting in the wings as a 'dormant company' at the moment but one wonders what his plans are for it if the MHCLG fall for all this and let the IAS continue (as their proposals are unclear and it looks like this Government wants to be kick every important can down the road to rush in a bad Code):
