    Yeah, I did that last night so does that now mean 28 days from yesterday?

    I've noticed that 2 of the 3 PCNs seem to have been issued more than 14 days after the alleged incident. Is this what not complying with POFA 2012 means?

    It can do , if no windscreen PCNs were issued

    Yeah, it was all done by ANPR. Would that bit about not complying with POFA 2012 go in 'paragraph 3'? 

    I'm struggling with the defence tbh. I can't seem to find anything on the forum specifically relating to a July/August defence against smart parking and I just don't have the knowledge to know what to keep and change in the template. My head's a mess!

    3 PCNs might well end up with a hearing but DCB Legal do love to discontinue cases and are hearing averse so you can't be sure either way. However, your evidence of the pass at WS stage (later) should be the silver bullet.

    I think your paragraph 3 should be similar to all the other Smart Parking DCB claim threads with the extra bit in all of them (search the forum) that points out that the Claim is untrue because Smart never used the POFA 2012 in 2021 and know full well they cannot hold a registered keeper liable.

    I searched for the words I'd already put in bold for you!  I did that in my first reply to you a few days ago, to make it clear they were the search words.

    Hi again. Just a little update on this one. The land owner (shopping centre) manager has been really helpful and managed to get the 3 PCNs cancelled by Smart Parking. Do I wait for the court claim to be dropped at their end? Or is there something I should be doing to make sure that happens? Thanks.

    Carry on until you get a notice of Discontinuance from DCB Legal 

    Email them , say what you have received and tell them to check with their client and then issue the N279 discontinuation document ASAP

    I'm unsure: are you saying you haven't submitted a defence yet? Eeek you MUST!

    DCB Legal won't stop (yet) or even know about this and you'll get a CCJ and bailiffs if you fail to defend a claim. Hopefully you have already.

    And even though this is stressful: while your case is quiet please do the government's Public Consultation. 
    We need every poster to come back & complete this vital Consultation before the deadline (this time next week).

    I have been working on the defence but haven't filed it yet. I assume I should now mention the fact that the PCNs have been cancelled? Would that be in paragraph 3?

    Just state that the defendant has written confirmation from the landowner that all the PCNs have been cancelled,  adding it to paragraph 3, at the end

    If you are past the deadline for submitting the defence,  get it done ASAP on MCOL 

    With an issue date of 6th August,  your deadline is 4pm on 8th September,  but it MUST be done or a default CCJ will occur
