NIP wrong location

Seventh Anniversary Name Dropper First Post Combo Breaker
I’ve received a NIP for 25 in a 20 MPH zone
however the NIP states NW1 and I was in SW1 London ,

I have evidence from the Taxi app I use showing me in SW1

the 2 different locations are 4 miles apart

What can I do ?

I haven’t sent the NIP back yet I still have 14 days to do so

    Contact the issuing office and ask them - but don’t risk not responding within the timescales to name the driver. 

    Is there no photographic evidence provided - either in the letter of via an online portal ?

    There are only still pictures in the portal of a close-up of my grille and numberplate

    The traffic police lady said there’s a video, but I can’t see it in the portal

    If you’re adamant you weren’t there at that time then initial discussion should be with the office issuing the ticket and see what they suggest

    Make sure you do the following:

    1/ Don't give them time to issue a correct NIP within the 14 days
    2/ Make sure that you notify them no earlier than Day 14 and no later than Day 28 

    Edited to add - is there address other than the postcode?  If the address is incorrect but the post code has a typo, then it is doubtful you will get very far, but you could try getting them to drop it out of embarrassment

    location Park road between Baker Street and lodge road NW1

    I was at Bridges place between Wilton road and belgrave road SW1

    that is where the speed trap was , I saw the officer with a tripod

    my my argument is, there’s an error on the NIP so it should be cancelled 

    they keep saying you were still speeding somewhere

    Don't drip feed information, nothing winds them up more on that website, but they are knowledgable.

    So you do admit that you're bang to rights, but you're just arguing about the location on the paperwork?

    The phrase you're after is "de minimis".

    What are you actually being asked right now?
    "Were you driving?" - yes, you were.
    Or have you already done that, and you're deciding whether to take the course, FPN, or court date?

    Because if you take this to court, I *really* don't think you're going to win.

    Why not? 

    It is not just a typo the address is completely wrong, it is incumbent on the authorities to get these things right the first time.

    But AIUI the NIP is alleging a totally different place from that where the OP was at the time in question, isn't it?

    Aren't the two locations at least 3km apart?

    Why shouldn't the OP simply wait until it would be too late for an amended NIP to be issued and reply saying that no-one was driving the car at the alleged location at the alleged time because the car wasn't there?

    If the s172 request to nominate the driver specifies a location where the OP knows he wasn't, is he obliged to tell the rozzers he was somewhere else?

    Other than that I'd repeat earlier suggestions to go to FTLA fro best advice

    I'd guess that the camera van/tripod operator forgot to update the location of where it was between moves.
    So given the considerable distance between them I'd say you have a good chance of the Police suddenly deciding to cancel them all en-mass.

    Indeed it is essential to wait until there is no time for the police to re-issue the NIP within the 14 day period after the offense with the correct details on it.
    I'd be replying along the lines of while I was driving in that car at that time I/the car was not at the location specified in the NIP.
