    The joke by Viking is this 11 seconds scam.

    But the bigger scam is sending a keeper a notice saying they're liable under the POFA, yet refusing their right to appeal & deleting it!

    A keeper is perfectly entitled to appeal.

    Here's the BPA and DVLA's stated position on this (thanks to Siross for this useful DVLA email). It is not allowed to appeal to make appeal conditional upon saying who was driving:

    That was 11 years ago by David Dunford at the DVLA.

    Reiterate in the your reply that you are the registered keeper and are perfectly entitled to appeal. Re-appeal and complain.

    Under the heading Important notice to Registered Keeper the very first paragraph states that "you can appeal directly to the Operator".

    Is the "evidence" a pair of photos showing you entering and leaving?  And if so, are they timestamped with the same times written in the letter, 11 seconds apart?

    If they've just made an error transferring the timestamps onto the letter, then it's surely just an administrative inconsequence.  But if they are genuinely attempting to charge you for "parking" for 11 seconds, then I would gladly let this go all the way to court and see the court's reaction to being asked to rule that 11 seconds constitutes "parking".

    Interested to see the photos. I suspect covert CCTV on a building, focussed on your car, not ANPR at the entrance.

    Covert surveillance is illegal.

    Please show us the photos on their website when you pretend to pay. DO NOT PAY!

    the evidence was 2 photos of the car in a parking spot and a time stamp showing the date and time at18:48:44 & 18:48:55 11 seconds, not a single photo arriving or leaving with a time stamp. The way the photos have been taken it looks like they have been taken by an individual not CCTV

    You could also report this to the Competition and Markets Authority ('the CMA') as denying a right of appeal to a registered keeper is a breach of the Digital Markets, Competition and Consumers Act (DMCC Act)

    226 Misleading actions

    (1) For the purposes of this Chapter, a commercial practice involves a misleading action if the practice involves—

    (a) the provision of false or misleading information relating to a product, a trader or any other matter relevant to a transactional decision,

    (b) an overall presentation which is likely to deceive the average consumer about a matter relating to a product, a trader or any other matter relevant to a transactional decision,

    (c) any marketing of a product which creates confusion, or is likely to create confusion, with any product, trade mark, trade name or other distinguishing mark of another trader, or

    (d) a failure to comply with a requirement in a code of conduct to which subsection (5) applies in circumstances where the trader asserts that the trader acts in compliance with that code.
