Spring parking, DCB legal court claim

    Ok thanks, I’m going to do it later if I can get my head around it all and read up on everything you mentioned.
    Checked  the MCOL and no judgement has been lodged at the moment luckily.

    Just use the Template Defence! All ten paragraphs with her facts added in at 3.

    Don't put it off till tonight: a CCJ could happen at any minute as they just need to press a button! The defence takes ten minutes.

    DO IT NOW - SHE LOGS INTO MCOL. All done in her name not yours.

    In para 3 of the Template Defence she states this:

     3.  The Defendant was not the driver and denies liability. The driver was her husband. It is believed the parking charge was issued wrongly for 'not displaying a permit' because adjacent to where the driver parked had 3 or 4 spaces vaguely marked for permit holders only but the driver in fact parked next to the end parking place. Those spaces are for customers of the local shops to use.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Thanks very much for that I’ve sent the defence but as it was after 4pm it says it will only be looked at the next day.
    it shows up on the status thatbig has been submitted so hoping I got it in just in time.
    i really appreciate the help, I can stop stressing for a while now.

    Its not YOUR defence,  has to be done in the name of the defendant named on the claim form 
  • Yes, sorry should have said we did it together in her ,the defendants, name I meant to say that it’s not in my name.
    @Coupon-mad I will definitely take a look and join on the survey to help change the law, this kind of thing needs to be stopped.
  • Hi all, as a follow up to this I submitted the defence in my wife’s name 10/9 and it was acknowledged that it was received on the morning after on the mcol.
    I've heard nothing since, had no letters,emails or any updates on the mcol do I just sit and wait as it’s over 28 days now and read that’s the claimant deadline.

    no it really is not the claimants deadline at all, could be months
  • Ok thanks for the reply, i was being a bit optimistic thinking they missed a deadline I think or wishful thinking ha.
    just have to keep checking and wait.

    sorry it’s been a while I just wanted to update this and maybe get anyone’s thoughts on the latest.

    All the steps as expected have occurred with this being transfer to the chosen local county court which is Preston.

    Had this letter through this week which I’m hoping if I’m reading it correctly means the claim is being struck unless further evidence is provided by the claimant by 4pm 20th March.

    It also says I can update my defence on this but not sure whether I need to do that, I used the template defence at the time and edited it to suit my situation.

    So I’m now wondering do I need to do anything or just sit tight and wait for further correspondence from the county court hopefully to say all this has been thrown out and I’m a free man 😁

    Here is a copy of the said letter.

    Similar to the thread above, these city judges are definitely wising up

    Its your partner who would be free, you are a bystander ( stranger to the claim. )

    PPlease edit your thread title to something more suitable like
