Bought Jurassic park toy that’s not in the actual film

I bought a dinosaur toy by Mattel for my son who was really excited about watching the new Jurassic Park film - Rebirth …with the toy. Having watched the film for 2.5 hrs it transpired the dinosaur isn't in the film. He say there for the whole time waiting for it in his hand :(.
The packaging clearly states and markets it as official film merchandise. It’s a Mattel toy so they've been around for years so expect better..
Is this false advertising?
I sent them an email and just got a “thanks for your feedback - we’ll pass onto the marketing dept”. Am I permitted to take the toy back to the shop?

    There were three Jurassic Park films (1993, 1997 and 2001) and four Jurassic World films (2015, 2018, 2022 and 2025), which toy was it, as it may have been a dinosaur in one of the films but not the most recent one? However official merchandise does not mean that it is in the film, it just means it is a licensed product. Plenty of official merchandise is not in films, especially when it gets to toys which often just get into the general association with.

    Not unless the packaging specifically said "This dinosaur is in the film".

    That would depend on the shop's returns policy, at best it would be deemed a change of mind, but I doubt you would get a full refund even if they were willing to accept the return in the first place.

    Production of toys will typically begin a long time before the film is finalised so that the goods are in place to go live when the film hits the big screen. Obviously that introduces a risk that something that was planned to be in the film gets cut out for some reason.

    Jurassic Park is also broader than just the films, there are toys like Becklespinax which was in the animated Chaos Theory rather than the films. 

    So was the toy explicitly advertised as being from Rebirth?

    What is the dinosaur? There are lots of similar threads online and people have pointed out where they appeared. The 
    Purussaurus which does come in Rebirth packaging actually features in a computer game but was alegedly cut late into finalising the film. For those that still buy DVD/BluRay it may well appear on the cut scenes extras.

    So it was in one of the series, you just haven't seen that one yet.
    Where was the advert that says it was in Rebirth? I did look through the Fandom website and it does seem to suggest that it is.

    There can be various different cuts of major films in circulation. For examples certain violent (or other ) footage can be omitted when a film is shown on an aeroplane or before 9pm on national TV.

    Selling a product with a film’s branding is advertising/linking the dinosaur/ character as being in the film. It’s using the film to promote a toy at a price premium…otherwise it’s just a toy dinosaur sold at a lower price

    Google also says

    That’s tenuous advertising… “inspired by”. You shouldn’t have to research the toy prior to buying it when it’s film branded. Having an unidentifiable partial skeleton… cmon. Why not make a wholly mammoth, giant sloth in there as well…. And every other dinosaur.
