    Appreciate the replies thank you, I just realised Ive emailed the witness statement as opposed to sending it off is that OK?

    I have a had a small claims track hearing for my other one Vs Eurocarparks/DCLegal as well which I need to do , should I post that one?

    I have my telephone hearing date today at 2pm so wish me luck ... is there any last minute advice ?

    I'm wondering can I mention to the judge that I only had around 24-48hours to write my witness statement in time? Will there be an opportunity to bring this up ?

    Also I have a note mentioned about costs in the WS but didn't actually submit the A4 sheet with costs, can I try do this now and quickly email it in before the hearing or leave it now?

    What should I do about forgetting to attach costs with the WS ? Can I write one up and send now or should I leave it ?

    Well I'm pretty disappointed to say the least... it's been a tough lesson and the judge ruled in the car parks favour on the basis that there was enough signage....

    This is despite them providing shoddy photographs with a tree obscuring one of the signs , and missing photos of any entrance sign...

    £200 down...

    From I've gathered as long as this is paid within the 21 days it is not a CCJ?

    Also the judge I had completely dismissed the court's procedural error of sending everything to the wrong address... But is there any chance of appeal

    Unlikely to be scope for appeal because his or her view on the signage is subjective, so the judge was entitled to decide one way or the other. You can't appeal just because you don't like or agree with the judgment, I'm afraid.

    But what about Mazur? Did you voice that?

    What did the judge say about the claim being signed by Sarah Ensall, a non-authorised person? You had this legal point in your WS as I advised, yes?

    copy & adapt a WS with Mazur v Speechlys (which you should know that you obviously need too if you've been keeping up with threads here - it's new case law from September).

    That one was a good WS with sub headings in a DCB Legal case, my notes say. And it included Mazur v Speechlys so you can work with that one. Adding your own facts instead.


    At least - if the total is c£212 - it is LESS than the sum claimed and the judge dismissed the interest and the fakery of the added double recovery false £70 add-on. And you will get no CCJ as long as you pay in full straight away on DCB Legal's portal (NB: NOT DCB Ltd).
