Any discontinuation is typically expected just before the hearing fee is due to be paid by dcb legal,  a few weeks before the pencilled in hearing date,  that could be in 6 to 9 months time,  so 2026, courts are backlogged  !

You should inform all parties about a change of address for the service of papers,  in writing, ASAP

Its a Data Rectification Notice,  it is obvious to me that you should inform everybody about a change of address,  banks, insurance companies,  DVLA, Inland Revenue,  parking companies,  solicitors,  courts,  etc

As for it being St Helens,  ask them to transfer it to your local civil court
Thanks for the information, I had already updated my address but for whatever reason MCOL didn't seem to update it their end.

I've sent the St Helens courts an email about an address change so hopefully all good and I wait it out until and hearing date like you said,

Have you completed a DQ - N180 form?  If so, which court did you request?  The St. Helens one looks to be where the judge will allocate the hearing NOT where the hearing will take place.

Yes all done, defence and N180 all sorted. They said in mediation that my defence was template and weak but no actual argument against it. Obviously declined their offers of reduced settlement. So I await St Helens Courts now

My point was; which court did you request on your DQ (N180)?

Hello , need some urgent help please.

I've had an email from DCB legal with their full WS and saying I have a court hearing at St Helens in less than 2 weeks.

I've had no letters from the courts and had contacted them by email and phone saying I wanted it transferred to the Swansea courts where I have moved, (I also notified them of my address change!)

Please help on what to do? I'm currently trying to phone the courts as the date they have given me is impossible

Also my gatherings from the posts were that they normally drop it a week before the hearing in most cases, is this still likely?

I have 2 written emails in December stating my address change and of my request to change to a closer court in Swansea. I also phoned them around this time and they said that would be fine , but I've had this email from DCB saying I have a court hearing on St Helens in February..

I have been on the phone to the contact centre and they said I need to fill out an N244 form?

I think at the start before moving I did choose or was automatically assigned St Helens ,

However, after December when they had transferred it I contacted them 3-4 times (twice via email and twice by phone) about my about my address change and needing a local court, and had no correspondence (I had also been on the royal mail redirection service for my old address!) so surely this constitutes a procedural error?

It says they charge a £300 fee to change hearing dates on the N244 form which is crazy

Its more likely that the CNBC allocated the case to St Helens, the lawyers home court, they were making that error last year ( so unlikely to be you unless that is your local civil court. ? But its nowhere near Swansea )

Ask the court if the hearing fee was paid. ?

i was in Warrington before so it could have been my local court , im at the point where I'm genuinely thinking to phone DCB legal and make an offer to pay something to make this go away... 😩

The courts confirmed on the phone that there is a court date 18th Feb

Hello, yes I spoke to court contact centre again just now and they confirmed the hearing fee was paid...

What advice can you give please, I am pretty worried as I only found out about the 18th Feb date today and it's 350miles away from where I live and I cannot take it off work

I suspect the court only has your old address, so the hearing Order went there.

    1. Email a formal complaint to the HMCTS complaints email and show them the efforts you made by email (and mention the phone calls) to alert the Courts to the fact that you live in Swansea.

    DO THAT EMAIL NOW!

    2. You will have to file and serve your Witness Statement & exhibits - DO THIS TOMORROW - with a covering email saying that a complaint has been made to HMCTS because the Courts have ignored all your efforts to get the case properly transferred to Swansea, which the court service was alerted to months ago. The St Helens hearing must be vacated. You live 350 miles away from St Helens and of course, the Defendant will be unable to attend and has been completely disadvantaged by the court oversight.
