DCB/ECP ticket from June 2022

MrBernard62

Parking ticket from June 2022 (never received). DCBL were kind enough to send a few letters which bought me enough time to do some research and read through the guidance on this forum.
I received the letter of claim from DCB Legal and finally the claim form landed on my doorstep this week.
I will share PoC below.
Will start on my defence and post here for advice.
Not that it matters but context is that I wasn't driving (can confirm that I was at work and using a different car, one I have access to through work). Given the length of time that has passed I'm not 100% sure who was driving and not sure what the supposed breach is as I never received the original ticket or reminders.
Will keep you updated and hopefully join the long long list of people who have had their claim discontinued in the new year

Complete the AOS online on MCOL next week, ideally on Tuesday or later, no rush
Use the standard template defence, adapting the end of paragraph 2 and write paragraph 3, after reading other recent cases on here0 -
Yep you are on track for a discontinuance as long as you bung in a defence and follow the easy steps. And we hope you are ready to respond with us to the Public Consultation, which is now open for August. This is how to change the law.
What parking operators do is is a national disgrace and a drain on Society, in terms of money and anxiety. To be part of the push to change things in future, it's very important that people like this Defendant tell the Government that:
a) motorists have no faith in POPLA or the IAS and that there must be a SINGLE APPEALS SERVICE that people trust. The sector is crying out for an independent and impartial appeals service - not two involved in a race to the bottom - that will give a real option to resolve disputed cases out of court.
b). THE ENRICHMENT OF 'DEBT RECOVERY FEES' MUST BE COMPLETELY BANNED. CASES ARE NOT SOLVED BY DEMANDING MORE MONEY AND OFFERING A 'PAYMENT PLAN' THAT ONLY THE VULNERABLE PAY. DRAS LIKE DCB LEGAL MAKE NO MONEY IF THEY HANDLE DISPUTES IN THE SPIRIT OF THE APPEALS CHARTER, WHICH IS WHY THEY ALWAYS PLOUGH ON TO COURT CLAIMS AND CCJs, RATHER THAN OFFERING REAL RESOLUTION AT PRE-ACTION STAGE. THEY OFFER NOTHING, NO LEGITIMATE OPTION TO KEEP CASES OUT OF COURT.
Responses are invited to the Consultation now:

We will discuss it further next week on that thread if you want more focus.

Thanks both.Is it worth submitting a SAR to ECP at this stage? I’ve never seen the original PCs so would like to understand how it is I’ve supposedly breached the terms of the contract.0

Maybe do so after the case is transferred to your local civil court2 -
Better not to know - and the case will be discontinued anyway. Complete waste of time.
We'll discuss the consultation in more depth this week so do come back to add your responses for the Government. Please bookmark that thread and return!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
