DCB Legal, Employee's Induction Day & No Permit - Guidance Much Appreciated

Hi All, 

Received N1 from DCBL (date of issue 15/07). Used MCOL for AOS. Now drafting defence. Curious as to whether anyone would be of help as my defence doesn't look promising from the outset.  

My defence would comprise three limbs:
1) Employee of company (hotel) that was exempt from purcashing parking tickets at the time. Not informed of the procedure with regards to parking despite being informed that there was parking on-site. All employees are granted exemption to parking should the registration ipad be used.

2) Additional debt recovery costs - evidence of double recovery and thus an abuse of process (HHJ murch appeal judgment in CEL vs Chan) and claim should be struck out. 

3) POC state the alleged breach though with no supporting evidence thus woeful claim but will upload N1 for review. 

Would this be successful at a hearing? I doubt that (1) would stand as it's the driver's responsibility to ensure that parking in said car park was done correctly, as opposed to the hotel (regardless of it being the employee's first day on the job). I doubt that (2) would work as it didn't stand at my prior hearing for a seperate case which I didn't win (QDR, though they walked away with nothing close to what they claimed). I will leave (3) to the judgment of others as soon as I can upload the N1. 

Also, yes I did contact the hotel administrators by phone to enquire as to whether they could cancel the PCN. No assistance at all. Yes I should have put it in writing and written War and Peace to HR, but honestly I didn't want the trouble after I left the job. I'll be paying a pretty penny for that at court if it goes their way...

    Just to clarify: the car park itself is operated by ECP.

    Regarding 3)  evidence comes at the WS stage in several months time,  not with an N1SDT court claim pack 

    Chances are there wont be a hearing,  so we'll never know.  If you defend properly and dont miss deadlines then a discontinuation should happen just before the hearing fee is due,  same as all the other cases on here

    Make sure you redact personal data including password, VRM, etc but leave all dates showing.

    But you won't have a hearing.

    Everyone (hundreds of posters in the first half of 2025 alone) with a single PCN claim from DCB Legal, have easily beaten it. DCB Legal will discontinue by the New Year.

    No hearing, no costs, nowt scary.

    And if you want to be part of the push to change things in future, it's very important that people like you tell the Government that:


    a) you have no faith in POPLA or the IAS and that there must be the SINGLE APPEALS SERVICE that the Parking (Code of Practice) Act 2019 *almost* promised. As long as it is independent and impartial (and only ONE appeals service, not two involved in a race to the bottom) that will give a real option to resolve disputed cases out of court.

    b).  THAT THE ENRICHMENT OF 'DEBT RECOVERY FEES' MUST BE COMPLETELY BANNED. DISPUTED CASES ARE NOT SOLVED BY DEMANDING MORE MONEY AND OFFERING A 'PAYMENT PLAN'!

    c). Tell them about your experience and the complete and utter waste of court resources caused on a grand scale by DCB Legal,
