    I have sent an email to CUP Enforcement outlined in previous post and also looking to send this to the rental company:

    Subject: Re: PCN xxxx – Appeal and Liability Clarification

    Dear xxxx,

    Thank you for your email regarding the above-referenced charge.

    I would like to formally request a letter of authority so that I may appeal this charge directly with the issuing party. Please issue this at your earliest convenience.

    I also wish to raise a concern regarding the handling of this matter. The charge in question was issued by CUP Enforcement, a private parking company. As a member of the British Vehicle Rental and Leasing Association (BVRLA), Enterprise is expected to follow the BVRLA Code of Conduct, which states that when a private parking charge is received, the rental company should provide the hirer’s details to the parking operator. Once those details are provided, the operator should pursue the hirer directly under Schedule 4 of the Protection of Freedoms Act 2012.

    In this case, it appears that CUP Enforcement rejected the transfer of liability despite an active appeal already being underway between myself and the operator. This is particularly concerning given that two previous PCNs issued by CUP Enforcement were successfully transferred to me as the hirer, demonstrating that they had accepted hirer details in the past and were willing to engage directly. Their decision to reject the transfer in this instance contradicts that precedent and undermines the expected process outlined by the BVRLA.

    Given this, I respectfully request the following:

    • Confirmation that my details were provided to CUP Enforcement in accordance with BVRLA guidance.

    • Clarification as to why the charge was paid by Enterprise despite the operator’s failure to pursue the hirer directly.

    • Confirmation that Enterprise intends to raise this issue with CUP Enforcement to ensure compliance with industry standards and to prevent recurrence.

    I trust this matter will be reviewed accordingly and look forward to receiving the letter of authority to proceed with my appeal.
