Thank you all for your help! CL helped me through I think I couldn’t have handled the stress of knowing it could go either way if I slipped up in court but if they come again (please do!!) I’d be happy to take you on myself you bunch of muppets.

I will be taking this further and seeing if i can help someone else like you guys do.

Yes even though I argued the same points, I was just ignored. Makes me think they would’ve strung me along to see if I’d pay and maybe issue the CCJ or drop it last minute.

1) irrelevant now that a court claim has been issued 

2)  they issued a court claim,  not a CCJ, they cannot issue a CCJ,  judges do that task when required

Also, as predicted, DCB Legal have failed to list the dates of 10 PCNs.

So the POC fails in two ways. I recommend you ask Contestor Legal if they will take this on as a no-win-no-fee strike out application. If they will, they'll kill it for you and get their costs from Smart/DCB.

Wonder if DCB Legal charged Smart the £115 filing fee. IMHO I bet the Claimant gets the court fees charged to them even though the case being so poorly pleaded was in fact down to DCB and the decision to discontinue was (we believe) theirs too. 

So CL didn't do this case fee-free as a strike out application? They defended? Are they now seeking their costs from Smart?

We need every poster to come back & complete this vital Consultation before the deadline! Just 2 weeks left but please don't rush it. You can do some then save it and come back to it as you have time.

Any questions on the Consultation please ask - on the dedicated thread - but I've covered up to question 20 already in that first post, openly telling everyone what I'm going to put and/or what sort of evidence you might wish to use for your response, if you agree with what we'll be saying from our experience.

Whilst your answers must of course be your own, there are vital points to safeguard motorists interests to make, that many people may not think of without our guidance because we see cases every day and we know the legal background. 

However, people like you have lived & breathed the intimidation, greed and unfairness first hand so your voice is needed!
