    Please force the discontinuance by emailing DCB Legal threatening to seek costs as they are in breach of the hearing order, and of course requiring a copy of their NoD.

    The same lot were taking me to court. I called their bluff — my case was solid so it wasn’t really a gamble. During the mediation call they tried to get me to accept a 50% reduction, which I refused.

    I then sent a letter to the District Judge with a breakdown of my costs to date (over £1,000, which I know is more than the court can normally award) and explained that I expected the claimant to discontinue at the last minute, wasting the court’s time and mediation resources. I asked the court to consider awarding costs under CPR 27.14(2)(g), as advised on this forum.

    The trial was listed for 13th March. I had until 20th February to file my evidence and witness statement, and they had until 13th February to pay the £27 hearing fee. I already had my evidence pack ready, so I sent it immediately and copied in DCB Legal using every email address they had used.

    I emailed the court yesterday and they confirmed the fee had not been paid, so the trial has been vacated.

    I actually wanted my day in court, but I’m now looking forward to hopefully recovering some of my costs.

    I’ve also set up a Facebook group to inform motorists who previously paid charges at this car park — where there is no entrance signage — that they can request refunds under Version 9 of the BPA Code of Practice, Clause 23.4(c), if new evidence shows the charge was incorrectly enforced.

    If I’m awarded the £750 the court is able to grant, I plan to use part of it to personally reimburse some of the motorists who were caught out by these scammers by returning their £60. I’ll then take on their cases myself and help them pursue full refunds from the parking company.
