Not really - EasyJet were obliged to offer the passenger a choice between a rebooking or a refund, so it sounds like they failed to do this and simply took the easiest/cheapest option.  Having said that, it's true that they had no liability under the regulations for consequential losses, so the distinction is largely academic now....

 You agreed to the excess when you took out the policy, so the insurer are not at fault although I would be scouring the terms and conditions very carefully about the double excess if you took out a joint insurance policy. Did you, or did you each insure separately?

The airline have have no responsibility for consequential loss.
