Clean Air Zone fine - I was not the driver but logbook was still in my name.

I sold my car at 10 am to a dealer. They drove my vehicle into the Birmingham Clean Air Zone at 11 am, and therefore, I got a fine.

I have appealed this to the Traffic Penalty Tribunal, and they’ve said, “Because I did not provide a timestamp of the bank transfer, I am liable.”

The issue is I didn’t transfer ownership. They took the logbook with them.

One further piece of evidence I forgot to submit was that prior to the fine, I sent an email to DVLA stating I’m not the owner, as I notified the dealership that it didn’t update the ownership. I’ll add this, too.

The response from the authority.

Authority Summary: The appellant states that sold the vehicle on the date of the contravention but at 10:00am therefore, before the contravention took place. The evidence provided by the appellant (see pages 14 and 15 of evidence item 1) confirm the vehicle was sold on xxxx, however they do not confirm the time of the sale.

The Council would point out that the DVLA have named the appellant as the registered keeper/owner when the contravention occurred. It is therefore a matter for the appellant to provide the evidence to support his claim that he was not the keeper at the time the contravention took place. In view of this, the Council believes that the PCN was correctly issued and remains enforceable at the full rate of £120.

What can I do? If I provide the bank transfer with a timestamp, is this enough?
