First off I just want to say thank you for all of those involved in the creation of this forum. By reading through these threads I have gone from being in an absolute state to having the confidence to fight back against this practice.
Onto the matter at hand, I have recently received my letter of claim for an alleged parking charge from May last year. Please see detail in link below.
With my issue date being the 23 JUL I have today submitted my MCOL AOS using the help file on the thread (again thank you very much)
I am now at the stage of preparing my defense and have a quick question to start with:
Based on the "Claimant", the "Address for sending documentation and payments" and the "Particulars of Claim" should I still be following the defense guidance for Moorside Legal?
If it is ok I will follow up on this thread with a request for guidance on my case specific defense paragraph once i have established which guidance to follow.
I will continue to post updates in this thread to keep others in similar position up to date and hopefully give them the confidence that I have gained.
Thank you

Can't get that link to work - better to just post a picture, which you can do. Redact the same 4 things seen in the other claim threads.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

That's not a Letter of Claim, it's a live N1SDT Court Claim ! Dated 23rd July , UKCPS via Moorside Legal
The alleged breach is not pleaded so adapt the recent, new, template defence accordingly for Moorside Legal cases, adding in Chan and Akande
Please note, there is no S in the Word Defence2 -
Thank you!
Apologies for the confusion on the letter of claim/court claim. I submitted my AOS yesterday at the 5 day point so I think I'm on the right track up to this point.
I will get my DEFENCE drafted and posted in this thread.2 -
If it is needed, although I note you have now posted an image.

Secondly, we need you!
If you want to be part of the push to change things in future, it's very important that people like you join us to reply to the new Public Consultation, to tell the Government NOW that:
a) you have no faith in POPLA or the IAS and that there must be the SINGLE APPEALS SERVICE that the Parking (Code of Practice) Act 2019 *almost* promised. As long as it is independent (and only ONE appeals service, not two involved in a race to the bottom) that will give a real option to resolve disputed cases out of court.
b). THAT THE ENRICHMENT OF 'DEBT RECOVERY FEES' MUST BE COMPLETELY BANNED. DISPUTED CASES ARE NOT SOLVED BY A THUG THIRD PARTY DEMANDING MORE MONEY AND ENGINEERING A POINTLESS 'PAYMENT PLAN'.
c). Tell them about your experience and that your case proceeded to a claim precisely because (a) and (b) above mean there is no option, no safeguard for consumers EXCEPT court.
Responses are invited to the Consultation now:

Do it in August pleeease! We will discuss it all in more detail in the coming weeks on that thread.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

So I have put my draft defense together using both the generic template and the template specific to Moorside legal.
So in my defence I have:
Paragraphs 1-5: Taken from the moorside legal template.
Paragraph 6: will be "basic facts and/or admit or deny the paragraphs in the woeful POC one by one"
Paras 7-13: paras 4-10 of the standard defence template.
Firstly does that all sound right to you guys?
Secondly, are there any threads or do you guys have any specific advice on what to put in my paragraph 6?
PS. I will certainly be replying to the public consultation.1 -
Just post it for critique, but your strategy seems to be correct, if it fits into 122 lines0
