Help!! Gym subscription has being going out of my account for 2.5 years - I thought it was cancelled

    I don't honestly think that legally they are obliged to  refund you as you do not have any proof of an email asking them to cancel.  I get why you may have missed the payment given it is the same name as your childrens school.  The best thing you can do is appeal to them saying you remember cancelling in 2022 and hopefully they have records showing you have not been attending the gym since then.  Not receiving emails is not a reason as many of us opt out or just delete.  We have a country club membership and beyond emails confirming I have booked classes I have never received an email.  We do get a letter once a year informing us of price increases and notification of direct debit amounts so I am surprised you have not got at least one of those.

    Sorry OP, but unless you can turn up some proper proof of cancellation I think you will have to write this off as an expensive lesson learnt!
    Why would you knowingly keep that money? Those are real people and you don't know why you are helping them throw their hard-earned away for nothing.  They could be ill, or have lost a loved one, or be going though a divorce, or suffering an addiction, or supporting family members with the same.  And you also don't know what their financial circumstances are, or what financial hardships they might be facing, or why they haven't had the wherewithal to face their bank statement for a while. You don't know that like me they haven't made a simpe mistake 2.5 years ago and once it was made led to a huge loss. They might be dead.  And you are knowingly shrugging your shoulders so you can keep the money. Just because it's legal doesn't mean it's the right thing to do either.  
    They weren't paying by direct debit. In fact in those days most subscriptions were paid by cheque. It was their choice to renew and doing so needed the positive actions of writing one out and putting it in the post!

    Is it totally out of fashion to expect people to take at least some responsibility for their own actions (or the consequences of inaction)?

    You think you cancelled.
     They might think they have contacted you previously.

    on the other hand they may have proof they sent you guy an email which went into your junk folder, or they may have sent a letter that you binned because you thought it was junk mail or never arrived , which seems to be a common complaint these days. 

    Have you made sure the subscription is cancelled now?
     
    What did the gym company say when you   advised them that you are sure you cancelled the membership?
