Please post a link to them rules

This problem comes under keyword spamming, and is not explicitly stated.
Here are the rules on keyword spamming, which I'm sure you know back to front.

Quite well, just looking for where Ebay say you are not allowed to use "As new", which would surely be of help to all those people who fall foul of the well publisised rule.

Seems a little daft to have rules and then not tell anyone about them.

    How about here:

    In general:

'The inclusion of words as a means to attract viewers via eBay search engines that do not truly describe the actual item...'

Whether it is intentional or not, using the words 'As new' will draw unwarranted attention to your listing from those who searched using the word 'New'

    Comparisons
Sellers are not permitted to make comparisons between items in a listing title. Only in the description are sellers permitted to compare the item being offered to the functionality of one other similar product, so long as the listing is not misleading in any way, as to which company made the item offered.
    • Example not allowed:
      • The titles "Leather Handbag, like Chanel","Leather Handbag, Chanel style", or "Leather handbag, not Chanel" are not permitted on eBay because they make comparisons between the item being offered, a leather handbag, to a Chanel handbag.
Is it new? No? Then it's not 'Like new' or 'As new'

Put 'as new' all you like in the listing. But don't put it in the title, cos it aint new.
