I did just that, they just ignored it and have already put my p/x on sale. Is it a legal right that I have for them to fix my car in that 3 month warranty, as I think I should go to the small claims court. 

No, they can repair/replace/refund and they get to choose.

Depending on the dealer they may well just ignore it still and small claims might be the way but even that could mean you don't get money if they shut down beforehand.
